12 This bill modifies the authority of the State Tax Commission.
13 Highlighted Provisions:
14 This bill:
15 ▸ repeals the State Tax Commission's authority to adjust or defer taxes levied against
16 property assessed by the State Tax Commission;
17 ▸ allows a county legislative body to adjust or defer taxes levied by the State Tax
18 Commission against property located in the county under certain circumstances; and
19 ▸ makes technical and conforming changes.

28 Be it enacted by the Legislature of the state of Utah:
29 Section 1. Section 59-2-1347 is amended to read:
30 59-2-1347. Redemption -- Adjustment or deferral of taxes -- Interest.
31 (1) (a) If [
32 adjustment or deferral of taxes levied against property [
33 located in the county, the county legislative body may accept a sum less than the full amount
34 due [
35 of the county legislative body, the best human interests and the interests of the state and the
36 county are served.
37 (b) Nothing in this section prohibits [

44 (2) (a) [
45 adjustment or deferral described in Subsection (1), the applicant shall include a statement[
46 setting forth the following:

51 (B) for a deferral, the amount proposed to be deferred; and

53 (b) The commission shall prepare blank forms for an application for an adjustment or
54 deferral under this section.

57 deferral without the written consent of the holder of any mortgage or trust deed outstanding on
58 the property.

60 shall bear interest at a rate equal to the lesser of:
61 (i) 6%; or
62 (ii) the federal funds rate target:
63 (A) established by the Federal Open Markets Committee; and
64 (B) that exists on the January 1 immediately preceding the day on which the taxes are
65 deferred.

67 payable when the property is sold or otherwise conveyed.
68 (4) Within 10 days after [
69 legislative body grants an adjustment or deferral, the county legislative body [

71 county where the property involved is located. The publication shall contain:
72 (a) the name of the applicant;
73 (b) the parcel, serial, or account number of the property;
74 (c) the value of the property for the current year;
75 (d) the sum of the delinquent taxes, interest, and penalty due; and
76 (e) the adjusted amount paid or deferred.
