8     General Description:
9          This bill requires substitute teachers to complete certain training before employment.
10     Highlighted Provisions:
11          This bill:
12          ▸     requires substitute teachers to complete certain training before employment; and
13          ▸     makes technical and conforming changes.

22     Be it enacted by the Legislature of the state of Utah:
23          Section 1. Section 53E-6-901 is amended to read:
24          53E-6-901. Substitute teachers.
25          (1) A substitute teacher need not hold a license to teach, but school districts and charter
26     schools are encouraged to hire licensed personnel as substitutes when available.
27          (2) (a) [A person must] An individual shall submit to a background check under

28     Section 53G-11-402 prior to employment as a substitute teacher.
29          (b) Ŝ→ [
A] Except in a county of the fourth, fifth, or sixth class, a ←Ŝ substitute teacher
29a     hired through an employment agency, as described in Title 34,
30     Chapter 29, Employment Agencies, shall receive from the school district or charter school in
31     which the substitute will work, before employment as a substitute, the district's Ŝ→ [

32     training, including any training in a code of ethics or a code of conduct for teachers.
33          (3) A teacher's position in the classroom may not be filled by an unlicensed substitute
34     teacher for more than a total of 20 days during any school year unless licensed personnel are
35     not available.
36          (4) A person who is ineligible to hold a license for any reason other than professional
37     preparation may not serve as a substitute teacher.
