7     LONG TITLE
8     General Description:
9          This bill reallocates the number of judges for district and juvenile courts.
10     Highlighted Provisions:
11          This bill:
12          ▸     decreases the number of juvenile court judges for the Third Juvenile District upon
13     the retirement, resignation, or death of a juvenile judge;
14          ▸     increases the number of district court judges for the Fifth District when the number
15     of juvenile court judges for the Third Juvenile District decreases; and
16          ▸     makes technical and conforming changes.

19     Other Special Clauses:
20          This bill provides a special effective date.

26     Be it enacted by the Legislature of the state of Utah:
27          Section 1. Section 78A-1-103 is amended to read:
28          78A-1-103. Number of district judges.
29          (1) The number of district court judges shall be:

30          [(1)] (a) four district judges in the First District;
31          [(2)] (b) 14 district judges in the Second District;
32          [(3)] (c) 31 district judges in the Third District;
33          [(4)] (d) 13 district judges in the Fourth District;
34          [(5)] (e) except as provided in Subsection (2), six district judges in the Fifth District;
35          [(6)] (f) two district judges in the Sixth District;
36          [(7)] (g) three district judges in the Seventh District; and
37          [(8)] (h) three district judges in the Eighth District.
38          (2) If the number of juvenile court judges in the Third Juvenile District, as described in
39     Section 78A-1-104, is decreased to nine, the number of district court judges in the Fifth District
40     is increased to seven.
41          Section 2. Section 78A-1-104 is amended to read:
42          78A-1-104. Number of juvenile judges and jurisdictions.
43          (1) The number of juvenile court judges shall be:
44          [(1)] (a) two juvenile judges in the First Juvenile District;
45          [(2)] (b) six juvenile judges in the Second Juvenile District;
46          [(3)] (c) except as provided in Subsection (2), 10 juvenile judges in the Third Juvenile
47     District;
48          [(4)] (d) five juvenile judges in the Fourth Juvenile District;
49          [(5)] (e) three juvenile judges in the Fifth Juvenile District;
50          [(6)] (f) one juvenile judge in the Sixth Juvenile District;
51          [(7)] (g) two juvenile judges in the Seventh Juvenile District; and
52          [(8)] (h) two juvenile judges in the Eighth Juvenile District.
53          (2) (a) If there is a vacancy for a juvenile court judge in the Third Juvenile District, the
54     number of juvenile judges in the Third Juvenile District is decreased to nine.
55          (b) If a vacancy in the Third Juvenile District occurs and the number of juvenile judges
56     in the Third Juvenile District is decreased to nine, the governor shall fill the vacancy created in
57     Subsection 78A-1-103(2) for the Fifth District in accordance with Section 78A-10-104.

58          Section 3. Effective date.
59          If approved by two-thirds of all the members elected to each house, this bill takes effect
60     upon approval by the governor, or the day following the constitutional time limit of Utah
61     Constitution, Article VII, Section 8, without the governor's signature, or in the case of a veto,
62     the date of veto override.
