9 General Description:
10 This bill modifies provisions of Title 35A, Chapter 8, Housing and Community
11 Development Division.
12 Highlighted Provisions:
13 This bill:

15 ▸ describes duties of the director of the Housing and Community Development
16 Division, including the oversight of a Homeless Management Information System;
17 and
18 ▸ makes technical changes.

32 Be it enacted by the Legislature of the state of Utah:
33 Section 1. Section 35A-8-101 is amended to read:
34 35A-8-101. Definitions.
35 As used in this chapter:
36 (1) "Accessible housing" means housing which has been constructed or modified to be
37 accessible, as described in the State Construction Code or an approved code under Title 15A,
38 State Construction and Fire Codes Act.
39 (2) "Director" means the director of the division.
40 (3) "Division" means the Housing and Community Development Division.
41 (4) "Homeless Management Information System" or "HMIS" means an information
42 technology system that:
43 (a) is used to collect client-level data and data on the provision of housing and services
44 to homeless individuals and families and individuals at risk of homelessness in the state; and
45 (b) meets the requirements of the United States Department of Housing and Urban
46 Development.
47 Section 2. Section 35A-8-203 is enacted to read:
48 35A-8-203. Duties of director.
49 (1) The director shall:
50 (a) coordinate, with the concurrence of the Homeless Coordinating Committee, the
51 provision of homeless services in the state; and
52 (b) oversee, with the concurrence of Continuum of Care organizations approved by the
53 United States Department of Housing and Urban Development, a Homeless Management
54 Information System for the state that:
55 (i) shares client-level data between state agencies, local governments, and private
56 organizations that provide services to homeless individuals and families and individuals at risk
57 of homelessness in the state;
58 (ii) is effective as a case management system;
59 (iii) except for individuals receiving services who are victims of domestic violence,
60 includes an effective authorization protocol for encouraging individuals who are provided with
61 any homeless services in the state to provide accurate information to providers for inclusion in
62 the HMIS as a condition of receiving homeless services; and
63 (iv) meets the requirements of the United States Department of Housing and Urban
64 Development and other federal requirements.
65 (2) In overseeing the provision of homeless services in the state, the director:
66 (a) shall encourage the coordination of the provision of services to homeless
67 individuals among state agencies, local governments, and private organizations;
68 (b) except for a program or provider providing services to victims of domestic
69 violence, may not approve funding to a program or provider that does not enter into a written
70 agreement with the division to collect and share HMIS data regarding the provision of services
71 to homeless individuals; and
72 (c) may deny funding to a program or provider that fails to demonstrate the effective
73 collection and sharing of HMIS data regarding the provision of services to homeless
74 individuals.
75 Section 3. Appropriation.
76 The following sums of money are appropriated for the fiscal year beginning July 1,
77 2020, and ending June 30, 2021. These are additions to amounts previously appropriated for
78 fiscal year 2021. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
79 Act, the Legislature appropriates the following sums of money from the funds or accounts
80 indicated for the use and support of the government of the state of Utah.

86 The Legislature intends that:
87 (1) the Department of Workforce Services use the money in this appropriation to
88 improve the electronic Homeless Management Information System for the state so that the
89 system:
90 (a) is effective at collecting accurate, client-level data on the provision of housing and
91 services to individuals and families experiencing homelessness; and
92 (b) serves as an effective case management system for individuals and families
93 experiencing homelessness; and
94 (2) under Section 63J-1-603, the appropriation provided under this item not lapse at the
95 close of fiscal year 2021.
