8     LONG TITLE
9     General Description:
10          This joint resolution requests the development of recommendations for ordinances
11     related to construction or demolition material.
12     Highlighted Provisions:
13          This resolution:
14          ▸     acknowledges the disposal of construction or demolition material;
15          ▸     acknowledges that local ordinances could increase diversion rates; and
16          ▸     requests the Utah League of Cities and Towns and the Utah Association of Counties
17     to:
18               •     make recommendations as to local ordinances addressing diversion rates and
19     reuse of construction or demolition materials available to their members;
20               •     make recommendations as to local ordinances that are reasonable; and
21               •     make available to their members a repository of existing local ordinances
22     addressing diversion rates and reuse of construction or demolition materials.
23     Special Clauses:
24          None

26     Be it resolved by the Legislature of the state of Utah:
27          WHEREAS, "construction or demolition material" includes building materials,
28     packaging, and rubble resulting from construction, demolition, remodeling, and repair of
29     pavements, houses, commercial buildings, and other structures, and from road building and

30     land clearing that may be recycled or converted to scrap that is processed material for use in
31     new products;
32          WHEREAS, "diversion rate" means the percentage of construction or demolition
33     material diverted from disposal through methods including waste prevention, recycling, or
34     reuse;
35          WHEREAS, construction activities in the state generate construction or demolition
36     material that is currently being disposed;
37          WHEREAS, counties or municipalities can by ordinance increase the diversion rate for
38     construction or demolition material; and
39          WHEREAS, counties or municipalities are more likely to adopt ordinances to increase
40     the diversion rate for construction or demolition material if there are recommendations for how
41     these ordinances would work:
42          NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah
43     requests that the Utah League of Cities and Towns and the Utah Association of Counties make
44     recommendations to their members by December 31, 2020, regarding ordinances that a county
45     or municipality may adopt or modify to require:
46          (1) a range of diversion rates of construction or demolition materials from 50% to 75%
47     as determined by the Utah League of Cities and Towns and the Utah Association of Counties;
48     and
49          (2) a percentage of reuse of construction or demolition materials of 10%.
50          BE IT FURTHER RESOLVED that the Legislature requests that the recommendations
51     for ordinances under this resolution be reasonable and take into account issues such as the
52     availability in a geographic area of services for recycling.
53          BE IT FURTHER RESOLVED that the Legislature requests that the Utah League of
54     Cities and Towns and the Utah Association of Counties make available to their members by
55     December 31, 2020, a repository of existing local ordinances addressing diversion rates and
56     reuse of construction or demolition materials.
57          BE IT FURTHER RESOLVED that a copy of the resolution be provided to the Utah

58     League of Cities and Towns and the Utah Association of Counties.
