7 LONG TITLE
8 General Description:
9 This bill supplements or reduces appropriations otherwise provided for the support and
10 operation of state government for the fiscal year beginning July 1, 2019 and ending June 30, 2020.
11 Highlighted Provisions:
12 This bill:
13 ▸ provides appropriations for the use and support of higher education and certain state
14 agencies;
15 ▸ provides appropriations for other purposes as described; and
16 ▸ provides intent language.
17 Money Appropriated in this Bill:
18 This bill appropriates $657,616,300 in operating and capital budgets for fiscal year 2020,
19 including:
20 ▸ ($36,967,000) from the General Fund;
21 ▸ $155,892,300 from the Education Fund; and
22 ▸ $538,691,000 from various sources as detailed in this bill.
23 This bill appropriates $2,600 in expendable funds and accounts for fiscal year 2020,
24 including:
25 ▸ $212,300 from the General Fund; and
26 ▸ ($209,700) from various sources as detailed in this bill.
27 This bill appropriates $15,472,900 in business-like activities for fiscal year 2020.
28 This bill appropriates ($37,900) in restricted fund and account transfers for fiscal year 2020.
29 This bill appropriates $5,338,700 in transfers to unrestricted funds for fiscal year 2020.
30 This bill appropriates $4,800 in fiduciary funds for fiscal year 2020.
31 This bill appropriates $1,475,000 in capital project funds for fiscal year 2020.

37 Be it enacted by the Legislature of the state of Utah:
38 Section 1. FY 2020 Appropriations. The following sums of money are appropriated for the
39 fiscal year beginning July 1, 2019 and ending June 30, 2020. These are additions to amounts
40 otherwise appropriated for fiscal year 2020.
41 Subsection 1(a). Operating and Capital Budgets. Under the terms and conditions of
42 Title 63J, Chapter 1, Budgetary Procedures Act, the Legislature appropriates the following sums of
43 money from the funds or accounts indicated for the use and support of the government of the state of
44 Utah.

54 intends that appropriations of up to $3,000,000 to the Attorney
55 General's Office provided for in Item 49 of Chapter 9 Laws of
56 Utah 2019 not lapse at the close of Fiscal Year 2020. The use
57 of any unused funds is limited to purchase of computer
58 hardware and software, specific program
59 development/operation, pass-thru funds appropriated by the
60 Legislature and other one-time operational and capital
61 expenses.
62 The Legislature intends that the Attorney General's Office,
63 Criminal Department, may purchase up to six (6) additional
64 vehicles with department funds in Fiscal Year 2020 or Fiscal
65 Year 2021.

74 unused funds is limited to costs passed-thru to operate the local
75 CJC's or for one-time operational expenses.

To Attorney General - Contract Attorneys77 Under Section 63-J-1-603 of the Utah Code, the Legislature
78 intends that appropriations of up to $60,000 provided for
79 contract expense in Item 51 of Chapter Laws of Utah 2019 not
80 lapse at the close of Fiscal Year 2020. The use of any unused
81 funds is limited to professional services for attorneys under
82 contract with the Office of the Attorney General and other
83 litigation expenses.

To Attorney General - Prosecution Council85 Under Section 63-J-1-603 of the Utah Code, the Legislature
86 intends that appropriations of up to $150,000 provided for
87 contract expense in Item 52 of Chapter 9 Laws of Utah 2019
88 not lapse at the close of Fiscal Year 2020. The use of any
89 unused funds is limited to expense associated with providing
90 training and technical assistance to prosecutors. Funds set aside
91 for training commitments and other agreements may cross
92 fiscal years; thus, nonlapsing authority is requested to meet
93 financial commitments.

121 Utah Department of Corrections - Programs and Operations in
122 item 54 of chapter 9, Laws of Utah 2019 not lapse at the close
123 of Fiscal Year 2020. The use of any nonlapsing funds shall be
124 limited to the following items: stab & ballistic vests, uniforms,
125 radio supplies & equipment, authorized vehicle purchases,
126 inmate support & food costs, inmate programming, firearms &
127 ammunition, computer equipment/software & support,
128 equipment & supplies, employee training & development,
129 building & office remodeling, furniture, and special projects.
130 The Legislature intends that, if the Department of
131 Corrections is able to reallocate resources internally to fund
132 additional Adult Probation & Parole Agents, for every two
133 agents hired, the Legislature grants the authority to purchase
134 one vehicle with Department funds for FY 2020 and FY 2021.

166 the Legislature intends that appropriations of up to $2,500,000
167 provided to the Judicial Council/State Court Administrator -
168 Administration in Laws of Utah 2019 Chapter 9, Item 57 and
169 in Chapter 359, Item 7 and in Chapter 508, Items 75 and Items
170 78 through 92 shall not lapse at the close of Fiscal Year 2020.
171 The use of any unused funds is limited to market comparability
172 salary adjustments and career track advancement; employee
173 retention, training, education assistance, and incentives;
174 translation and interpreter services; IT programming and
175 contracted support; computer equipment and software; courts
176 security; special projects and studies; temporary employees
177 (law clerks); trial court program support and senior judge
178 assistance; grant match; and purchase of Utah code and rules
179 for judges.
180 Under Section 63J-1-603 of the Utah Code, the Legislature
181 intends that any unspent funds donated or paid to the juvenile
182 court by private sources for the purpose of compensatory
183 service programs shall not lapse at the close of Fiscal Year
184 2020. Unused funds are to be used to benefit the community
185 through juvenile community service programs such as graffiti
186 removal and community service.
187 Under Sections 63J-1-603 and 63J-1-602.1(66) of the Utah
188 Code, the Legislature intends that any unspent funds remaining
189 in the Law Library (Budget Line BAAA, Appropriation Code
190 BAB) shall not lapse at the close of Fiscal Year 2020. Unused
191 funds are to be used to supplement the costs of the Courts
192 Self-help Center.

195 Under Section 63J-1-603 of the Utah Code, the Legislature
196 intends that appropriations of up to $500,000 provided to the
197 Judicial Council/State Court Administrator-Contracts and
198 Leases in Laws of Utah 2019 Chapter 9, Item 58 and in
199 Chapter 359, Item 8 shall not lapse at the close of Fiscal Year
200 2020. The use of any non-lapsing funds is limited to lease cost
201 increases, contractual obligations and support.

204 intends that the appropriations of up to $800 provided to the

207 Fiscal Year 2020. The use of any non-lapsing funds is limited
208 to expenses related to the grand jury.

215 of any non-lapsing funds is limited to employee training,
216 development, and incentives; computer equipment and

218 employees.

225 Chapter 359, Item 10 shall not lapse at the close of Fiscal Year
226 2020. The use of any non-lapsing funds is limited to expenses
227 for jury, witness fees and interpretation services.

244 Chapter 9 Laws of Utah 2019 not lapse at the close of fiscal
245 year 2020. The use of any unused funds is limited to contracts
246 between Salt Lake County and other counties to house inmates
247 or for housing Salt Lake County inmates in Oxbow.

249 Commission on Criminal and Juvenile Justice for housing
250 prisoners from Salt Lake County in other counties be limited to
251 the rate of $26 per day, per prisoner.

269 through grant programs, and legal costs associated with

426 Training (POST) be able to utilize the funding it received to
427 replace simulators or for other repair needs at POST such as
428 the indoor shooting range or the EVO track.

436 intends that appropriations of up to $10,000,000 provided for
437 The Department of Public Safety - Programs and Operations
438 not lapse at the close of Fiscal Year 2020. This amount
439 excludes any nonlapsing funds from accounts listed under
440 section 63J-1-602.1 and section 63J-1-602.2. Funding shall be
441 used for equipment, technology, emergencies, and other
442 one-time operating expenses. Under section 63J-1-603 of the
443 Utah Code, the Legislature intends that PSAP dedicated credits
444 of up to $1,200,000 provided for the Department of Public
445 Safety - Programs and Operations CITS Communications
446 division not lapse at the close of Fiscal Year 2020.
447 The Legislature intends that the Department of Public
448 Safety is authorized to increase its fleet by the same number of
449 new officers or vehicles authorized and funded by the
450 Legislature for Fiscal Year 2020 and Fiscal Year 2021.
451 The Legislature intends that any proceeds from the sale of
452 the salvaged helicopter parts and any insurance
453 reimbursements for helicopter repair are to be used by the
454 department for its Aero Bureau operations. The Department of
455 Public Safety is authorized to increase its fleet by the same
456 number of new officers or vehicles authorized and funded by
457 the Legislature for Fiscal Year 2020 and Fiscal Year 2021.
458 The Legislature intends that the State Bureau of
459 Investigations within the Department of Public Safety be able
460 to use $107,738.03 of unclaimed and abandoned seized funds
461 for purposes of public interest. Examples of public interest
462 include payment of court awarded attorney fees and interest
463 charges. Legislative authority is required under Section
464 24-3-103(7).
465 The Legislature intends that the Utah Department of Public
466 Safety be able to purchase up to six vehicles for its centralized
467 evidence management program.
