8     LONG TITLE
9     General Description:
10          This bill requires that the College of Mines and Earth Sciences be transferred from the
11     University of Utah to Utah State University Eastern.
12     Highlighted Provisions:
13          This bill:
14          ▸     defines terms; and
15          ▸     requires that the College of Mines and Earth Sciences and all departments in the
16     college, the Utah Engineering Experiment Station established in conjunction with
17     the College of Mines and Earth Sciences, and the Utah Research Institute for Mine
18     Safety and Productivity, be transferred from the University of Utah to Utah State
19     University Eastern before the beginning of the fall semester of 2022.

31     Be it enacted by the Legislature of the state of Utah:
32          Section 1. Section 40-2-205 is amended to read:
33          40-2-205. Utah Research Institute for Mine Safety and Productivity --
34     Designation -- Duties.
35          (1) As used in this section[, "institute"]:
36          (a) "College" means the College of Mines and Earth Sciences established in Section
37     53B-17-401.
38          (b) "Institute" means the [University of] Utah Center for Mining Safety and Health
39     Excellence, designated as the Utah Research Institute for Mine Safety and Productivity in
40     Subsection (2).
41          (2) The [University of] Utah Center for Mining Safety and Health Excellence is
42     designated as the Utah Research Institute for Mine Safety and Productivity.
43          (3) In coordination with the council, the institute may:
44          (a) organize symposia, presentations, or other academic meetings; and
45          (b) identify and propose research projects on topics related to mining safety and
46     productivity.
47          (4) (a) The institute shall transfer to Utah State University Eastern no later than August
48     31, 2022, in conjunction with the transfer of the college described in Section 53B-17-401.
49          (b) Following the transfer of the institute, the institute shall be located in the
50     geographic region served by Utah State University Eastern.
51          Section 2. Section 53B-17-401 is amended to read:
52          53B-17-401. College of Mines and Earth Sciences -- Beneficiary of land grants --
53     Courses of study.
54          (1) As used in this section "college" means the College of Mines and Earth Sciences
55     established in this section.
56          (2) There is established a College of Mines and Earth Sciences [at the University of
57     Utah].
58          [(2)] (3) The college is the beneficiary of all land grants and appropriations made or to

59     be made by the United States to the state for the establishment and maintenance of a school of
60     mines.
61          (4) The college, including all departments within the college, shall transfer to Utah
62     State University Eastern no later than August 31, 2022.
63          (5) Following the transfer of the college to Utah State University Eastern:
64          (a) faculty of the college at the University of Utah shall:
65          (i) retain their positions within the college at Utah State University Eastern; or
66          (ii) be offered a comparable position at the University of Utah; and
67          (b) Utah State University Eastern shall be the beneficiary of all land grants and
68     appropriations described in Subsection (3), and the proceeds from land described in Subsection
69     (3).
70          [(3)] (6) (a) The college [may] shall offer [courses] accredited degrees in and related to
71     mining, metallurgical engineering, and electrical engineering, [and other branches of
72     engineering that pertain to mining] including mineral processing and extractive metallurgy.
73          (b) The college may offer courses in electrical engineering, geology, geophysics,
74     industrial safety, mineral resource management, and other areas pertinent to the viability and
75     sustainability of the state's mineral resources industries.
76          Section 3. Section 53B-17-402 is amended to read:
77          53B-17-402. Utah Engineering Experiment Station.
78          (1) As used in this section, "station" means the Utah Engineering Experiment Station
79     established in this section.
80          (2) There is established a Utah Engineering Experiment Station in conjunction with the
81     College of Mines and Earth Sciences.
82          [(2)] (3) [The] Except as provided in Subsection (4), the station is controlled and
83     managed by the University of Utah.
84          (4) (a) The station shall transfer to Utah State University Eastern no later than August
85     31, 2022, in conjunction with the transfer of the College of Mines and Earth Sciences described
86     in Subsection 53B-17-401(4).
87          (b) Following the transfer of the station, the station shall be:
88          (i) controlled and managed by Utah State University Eastern; and
89          (ii) located in the geographic region served by Utah State University Eastern.

90          Section 4. Section 53B-17-403 is amended to read:
91          53B-17-403. Functions of the station.
92          (1) As used in this section, "station" means the same as that term is defined in Section
93     53B-17-402.
94          [(1)] (2) The station has the following functions:
95          (a) to conduct experiments and investigations on matters that have the potential to
96     benefit the state's industrial interests or would be for the public good; and
97          (b) to inform the public of the results of the experiments and investigations conducted
98     by the station.
99          [(2)] (3) The station is not to conduct experiments or investigations on those matters
100     that more properly relate to the functions of Utah State University's agricultural experiment
101     station established in Section 53B-18-101.
102          [(3)] (4) (a) [The] Except as provided in Subsection (4)(b), the University of Utah
103     [makes] shall make an annual report on the [engineering experiment] station to the governor at
104     a time designated by the governor.
105          (b) Following the transfer of the station to Utah State University Eastern described in
106     Section 53B-17-402, Utah State University Eastern shall make an annual report on the station
107     to the governor at a time designated by the governor.
