9 This bill creates the Latino Community Support special group license plate.

35 Be it enacted by the Legislature of the state of Utah:
36 Section 1. Section 13-1-16 is enacted to read:
37 13-1-16. Latino Community Support Restricted Account.
38 (1) There is created in the General Fund a restricted account known as the "Latino
39 Community Support Restricted Account."
40 (2) The account shall be funded by:
41 (a) contributions deposited into the account in accordance with Section 41-1a-422;
42 (b) private contributions; and
43 (c) donations or grants from public or private entities.
44 (3) (a) The state treasurer shall invest money in the account according to Title 51,
45 Chapter 7, State Money Management Act.
46 (b) The Division of Finance shall deposit interest or other earnings derived from
47 investment of account money into the General Fund.
48 (4) Subject to appropriation, the department shall distribute the money in the account
49 to one or more charitable organizations that:
50 (a) are tax exempt under Section 501(c)(3), Internal Revenue Code; and
51 (b) have as a primary part of the organization's mission to strengthen the state's Latino
52 community by:
53 (i) creating strong leaders through education and mentoring;
54 (ii) providing scholarships and educational financial support; and
55 (iii) recognizing academic and vocational achievement, and school and community
56 leadership.
57 (5) The department may also expend funds in the account to pay the costs of issuing or
58 reordering Latino Community support special group license plate decals.
59 (6) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
60 department shall make rules providing procedures for an organization to apply to receive
61 money under this section.
62 Section 2. Section 41-1a-418 is amended to read:
63 41-1a-418. Authorized special group license plates.
64 (1) The division shall only issue special group license plates in accordance with this
65 section through Section 41-1a-422 to a person who is specified under this section within the
66 categories listed as follows:
67 (a) disability special group license plates issued in accordance with Section 41-1a-420;
68 (b) honor special group license plates, as in a war hero, which plates are issued for a:
69 (i) survivor of the Japanese attack on Pearl Harbor;
70 (ii) former prisoner of war;
71 (iii) recipient of a Purple Heart;
72 (iv) disabled veteran;
73 (v) recipient of a gold star award issued by the United States Secretary of Defense; or
74 (vi) recipient of a campaign or combat theater award determined by the Department of
75 Veterans and Military Affairs;
76 (c) unique vehicle type special group license plates, as for historical, collectors value,
77 or other unique vehicle type, which plates are issued for:
78 (i) a special interest vehicle;
79 (ii) a vintage vehicle;
80 (iii) a farm truck; or
81 (iv) (A) until Subsection (1)(c)(iv)(B) or (4) applies, a vehicle powered by clean fuel as
82 defined in Section 59-13-102; or
83 (B) beginning on the effective date of rules made by the Department of Transportation
84 authorized under Subsection 41-6a-702(5)(b) and until Subsection (4) applies, a vehicle
85 powered by clean fuel that meets the standards established by the Department of Transportation
86 in rules authorized under Subsection 41-6a-702(5)(b);
87 (d) recognition special group license plates, which plates are issued for:
88 (i) a current member of the Legislature;
89 (ii) a current member of the United States Congress;
90 (iii) a current member of the National Guard;
91 (iv) a licensed amateur radio operator;
92 (v) a currently employed, volunteer, or retired firefighter until June 30, 2009;
93 (vi) an emergency medical technician;
94 (vii) a current member of a search and rescue team;
95 (viii) a current honorary consulate designated by the United States Department of
96 State;
97 (ix) an individual supporting commemoration and recognition of women's suffrage;
98 (x) an individual supporting a fraternal, initiatic order for those sharing moral and
99 metaphysical ideals, and designed to teach ethical and philosophical matters of brotherly love,
100 relief, and truth; or
101 (xi) an individual supporting the Utah Wing of the Civil Air Patrol; or
102 (e) support special group license plates, as for a contributor to an institution or cause,
103 which plates are issued for a contributor to:
104 (i) an institution's scholastic scholarship fund;
105 (ii) the Division of Wildlife Resources;
106 (iii) the Department of Veterans and Military Affairs;
107 (iv) the Division of Parks and Recreation;
108 (v) the Department of Agriculture and Food;
109 (vi) the Guardian Ad Litem Services Account and the Children's Museum of Utah;
110 (vii) the Boy Scouts of America;
111 (viii) spay and neuter programs through No More Homeless Pets in Utah;
112 (ix) the Boys and Girls Clubs of America;
113 (x) Utah public education;
114 (xi) programs that provide support to organizations that create affordable housing for
115 those in severe need through the Division of Real Estate;
116 (xii) the Department of Public Safety;
117 (xiii) programs that support Zion National Park;
118 (xiv) beginning on July 1, 2009, programs that provide support to firefighter
119 organizations;
120 (xv) programs that promote bicycle operation and safety awareness;
121 (xvi) programs that conduct or support cancer research;
122 (xvii) programs that create or support autism awareness;
123 (xviii) programs that create or support humanitarian service and educational and
124 cultural exchanges;
125 (xix) until September 30, 2017, programs that conduct or support prostate cancer
126 awareness, screening, detection, or prevention;
127 (xx) programs that support and promote adoptions;
128 (xxi) programs that create or support civil rights education and awareness;
129 (xxii) programs that support issues affecting women and children through an
130 organization affiliated with a national professional men's basketball organization;
131 (xxiii) programs that strengthen youth soccer, build communities, and promote
132 environmental sustainability through an organization affiliated with a professional men's soccer
133 organization;
134 (xxiv) programs that support children with heart disease;
135 (xxv) programs that support the operation and maintenance of the Utah Law
136 Enforcement Memorial;
137 (xxvi) programs that provide assistance to children with cancer;
138 (xxvii) programs that promote leadership and career development through agricultural
139 education;
140 (xxviii) the Utah State Historical Society;
141 (xxix) programs to transport veterans to visit memorials honoring the service and
142 sacrifices of veterans; [
143 (xxx) programs that promote motorcycle safety awareness[
144 (xxxi) programs dedicated to strengthening the state's Latino community through
145 education, mentoring, and leadership opportunities.
146 (2) (a) The division may not issue a new type of special group license plate or decal
147 unless the division receives:
148 (i) (A) a private donation for the start-up fee established under Section 63J-1-504 for
149 the production and administrative costs of providing the new special group license plates or
150 decals; or
151 (B) a legislative appropriation for the start-up fee provided under Subsection
152 (2)(a)(i)(A); and
153 (ii) beginning on January 1, 2012, and for the issuance of a support special group
154 license plate authorized in Section 41-1a-422, at least 500 completed applications for the new
155 type of support special group license plate or decal to be issued with all fees required under this
156 part for the support special group license plate or decal issuance paid by each applicant.
157 (b) (i) Beginning on January 1, 2012, each participating organization shall collect and
158 hold applications for support special group license plates or decals authorized in Section
159 41-1a-422 on or after January 1, 2012, until it has received at least 500 applications.
160 (ii) Once a participating organization has received at least 500 applications, it shall
161 submit the applications, along with the necessary fees, to the division for the division to begin
162 working on the design and issuance of the new type of support special group license plate or
163 decal to be issued.
164 (iii) Beginning on January 1, 2012, the division may not work on the issuance or design
165 of a new support special group license plate or decal authorized in Section 41-1a-422 until the
166 applications and fees required under this Subsection (2) have been received by the division.
167 (iv) The division shall begin issuance of a new support special group license plate or
168 decal authorized in Section 41-1a-422 on or after January 1, 2012, no later than six months
169 after receiving the applications and fees required under this Subsection (2).
170 (c) (i) Beginning on July 1, 2009, the division may not renew a motor vehicle
171 registration of a motor vehicle that has been issued a firefighter recognition special group
172 license plate unless the applicant is a contributor as defined in Subsection
173 41-1a-422(1)(a)(ii)(D) to the Firefighter Support Restricted Account.
174 (ii) A registered owner of a vehicle that has been issued a firefighter recognition
175 special group license plate prior to July 1, 2009, upon renewal of the owner's motor vehicle
176 registration shall:
177 (A) be a contributor to the Firefighter Support Restricted Account as required under
178 Subsection (2)(c)(i); or
179 (B) replace the firefighter recognition special group license plate with a new license
180 plate.
181 (3) Beginning on July 1, 2011, if a support special group license plate or decal type
182 authorized in Section 41-1a-422 and issued on or after January 1, 2012, has fewer than 500
183 license plates issued each year for a three consecutive year time period that begins on July 1,
184 the division may not issue that type of support special group license plate or decal to a new
185 applicant beginning on January 1 of the following calendar year after the three consecutive year
186 time period for which that type of support special group license plate or decal has fewer than
187 500 license plates issued each year.
188 (4) Beginning on July 1, 2011, the division may not issue to an applicant a unique
189 vehicle type license plate for a vehicle powered by clean fuel under Subsection (1)(c)(iv).
190 (5) (a) Beginning on October 1, 2017, the division may not issue a new prostate cancer
191 support special group license plate.
192 (b) A registered owner of a vehicle that has been issued a prostate cancer support
193 special group license plate before October 1, 2017, may renew the owner's motor vehicle
194 registration, with the contribution allocated as described in Section 41-1a-422.
195 Section 3. Section 41-1a-422 is amended to read:
196 41-1a-422. Support special group license plates -- Contributor -- Voluntary
197 contribution collection procedures.
198 (1) As used in this section:
199 (a) (i) Except as provided in Subsection (1)(a)(ii), "contributor" means a person who
200 has donated or in whose name at least $25 has been donated to:
201 (A) a scholastic scholarship fund of a single named institution;
202 (B) the Department of Veterans and Military Affairs for veterans programs;
203 (C) the Division of Wildlife Resources for the Wildlife Resources Account created in
204 Section 23-14-13, for conservation of wildlife and the enhancement, preservation, protection,
205 access, and management of wildlife habitat;
206 (D) the Department of Agriculture and Food for the benefit of conservation districts;
207 (E) the Division of Parks and Recreation for the benefit of snowmobile programs;
208 (F) the Guardian Ad Litem Services Account and the Children's Museum of Utah, with
209 the donation evenly divided between the two;
210 (G) the Boy Scouts of America for the benefit of a Utah Boy Scouts of America
211 council as specified by the contributor;
212 (H) No More Homeless Pets in Utah for distribution to organizations or individuals
213 that provide spay and neuter programs that subsidize the sterilization of domestic animals;
214 (I) the Utah Alliance of Boys and Girls Clubs, Inc. to provide and enhance youth
215 development programs;
216 (J) the Utah Association of Public School Foundations to support public education;
217 (K) the Utah Housing Opportunity Restricted Account created in Section 61-2-204 to
218 assist people who have severe housing needs;
219 (L) the Public Safety Honoring Heroes Restricted Account created in Section 53-1-118
220 to support the families of fallen Utah Highway Patrol troopers and other Department of Public
221 Safety employees;
222 (M) the Division of Parks and Recreation for distribution to organizations that provide
223 support for Zion National Park;
224 (N) the Firefighter Support Restricted Account created in Section 53-7-109 to support
225 firefighter organizations;
226 (O) the Share the Road Bicycle Support Restricted Account created in Section
227 72-2-127 to support bicycle operation and safety awareness programs;
228 (P) the Cancer Research Restricted Account created in Section 26-21a-302 to support
229 cancer research programs;
230 (Q) Autism Awareness Restricted Account created in Section 53F-9-401 to support
231 autism awareness programs;
232 (R) Humanitarian Service and Educational and Cultural Exchange Restricted Account
233 created in Section 9-17-102 to support humanitarian service and educational and cultural
234 programs;
235 (S) Prostate Cancer Support Restricted Account created in Section 26-21a-303 for
236 programs that conduct or support prostate cancer awareness, screening, detection, or prevention
237 until September 30, 2017, and beginning on October 1, 2017, upon renewal of a prostate cancer
238 support special group license plate, to the Cancer Research Restricted Account created in
239 Section 26-21a-302 to support cancer research programs;
240 (T) the Choose Life Adoption Support Restricted Account created in Section
241 62A-4a-608 to support programs that promote adoption;
242 (U) the Martin Luther King, Jr. Civil Rights Support Restricted Account created in
243 Section 9-18-102;
244 (V) the National Professional Men's Basketball Team Support of Women and Children
245 Issues Restricted Account created in Section 62A-1-202;
246 (W) the Utah Law Enforcement Memorial Support Restricted Account created in
247 Section 53-1-120;
248 (X) the Children with Cancer Support Restricted Account created in Section
249 26-21a-304 for programs that provide assistance to children with cancer;
250 (Y) the National Professional Men's Soccer Team Support of Building Communities
251 Restricted Account created in Section 9-19-102;
252 (Z) the Children with Heart Disease Support Restricted Account created in Section
253 26-58-102;
254 (AA) the Utah Intracurricular Student Organization Support for Agricultural Education
255 and Leadership Restricted Account created in Section 4-42-102;
256 (BB) the Division of Wildlife Resources for the Support for State-Owned Shooting
257 Ranges Restricted Account created in Section 23-14-13.5, for the creation of new, and
258 operation and maintenance of existing, state-owned firearm shooting ranges;
259 (CC) the Utah State Historical Society to further the mission and purpose of the Utah
260 State Historical Society;
261 (DD) the Motorcycle Safety Awareness Support Restricted Account created in Section
262 72-2-130; [
263 (EE) the Transportation of Veterans to Memorials Support Restricted Account created
264 in Section 71-14-102[
265 (FF) the Latino Community Support Restricted Account created in Section 13-1-16.
266 (ii) (A) For a veterans special group license plate described in Subsection
267 41-1a-421(1)(a)(v) or 41-1a-422(4), "contributor" means a person who has donated or in whose
268 name at least a $25 donation at the time of application and $10 annual donation thereafter has
269 been made.
270 (B) For a Utah Housing Opportunity special group license plate, "contributor" means a
271 person who:
272 (I) has donated or in whose name at least $30 has been donated at the time of
273 application and annually after the time of application; and
274 (II) is a member of a trade organization for real estate licensees that has more than
275 15,000 Utah members.
276 (C) For an Honoring Heroes special group license plate, "contributor" means a person
277 who has donated or in whose name at least $35 has been donated at the time of application and
278 annually thereafter.
279 (D) For a firefighter support special group license plate, "contributor" means a person
280 who:
281 (I) has donated or in whose name at least $15 has been donated at the time of
282 application and annually after the time of application; and
283 (II) is a currently employed, volunteer, or retired firefighter.
284 (E) For a cancer research special group license plate, "contributor" means a person who
285 has donated or in whose name at least $35 has been donated at the time of application and
286 annually after the time of application.
287 (F) For a Martin Luther King, Jr. Civil Rights Support special group license plate,
288 "contributor" means a person who has donated or in whose name at least $35 has been donated
289 at the time of application and annually thereafter.
290 (G) For a Utah Law Enforcement Memorial Support special group license plate,
291 "contributor" means a person who has donated or in whose name at least $35 has been donated
292 at the time of application and annually thereafter.
293 (b) "Institution" means a state institution of higher education as defined under Section
294 53B-3-102 or a private institution of higher education in the state accredited by a regional or
295 national accrediting agency recognized by the United States Department of Education.
296 (2) (a) An applicant for original or renewal collegiate special group license plates under
297 Subsection (1)(a)(i) must be a contributor to the institution named in the application and
298 present the original contribution verification form under Subsection (2)(b) or make a
299 contribution to the division at the time of application under Subsection (3).
300 (b) An institution with a support special group license plate shall issue to a contributor
301 a verification form designed by the commission containing:
302 (i) the name of the contributor;
303 (ii) the institution to which a donation was made;
304 (iii) the date of the donation; and
305 (iv) an attestation that the donation was for a scholastic scholarship.
306 (c) The state auditor may audit each institution to verify that the money collected by the
307 institutions from contributors is used for scholastic scholarships.
308 (d) After an applicant has been issued collegiate license plates or renewal decals, the
309 commission shall charge the institution whose plate was issued, a fee determined in accordance
310 with Section 63J-1-504 for management and administrative expenses incurred in issuing and
311 renewing the collegiate license plates.
312 (e) If the contribution is made at the time of application, the contribution shall be
313 collected, treated, and deposited as provided under Subsection (3).
314 (3) (a) An applicant for original or renewal support special group license plates under
315 this section must be a contributor to the sponsoring organization associated with the license
316 plate.
317 (b) This contribution shall be:
318 (i) unless collected by the named institution under Subsection (2), collected by the
319 division;
320 (ii) considered a voluntary contribution for the funding of the activities specified under
321 this section and not a motor vehicle registration fee;
322 (iii) deposited into the appropriate account less actual administrative costs associated
323 with issuing the license plates; and
324 (iv) for a firefighter special group license plate, deposited into the appropriate account
325 less:
326 (A) the costs of reordering firefighter special group license plate decals; and
327 (B) the costs of replacing recognition special group license plates with new license
328 plates under Subsection 41-1a-1211(13).
329 (c) The donation described in Subsection (1)(a) must be made in the 12 months prior to
330 registration or renewal of registration.
331 (d) The donation described in Subsection (1)(a) shall be a one-time donation made to
332 the division when issuing original:
333 (i) snowmobile license plates; or
334 (ii) conservation license plates.
335 (4) Veterans license plates shall display one of the symbols representing the Army,
336 Navy, Air Force, Marines, Coast Guard, or American Legion.
337 Section 4. Section 63I-1-263 is amended to read:
338 63I-1-263. Repeal dates, Titles 63A to 63N.
339 (1) In relation to the Utah Transparency Advisory Board, on January 1, 2025:
340 (a) Subsection 63A-1-201(1) is repealed;
341 (b) Subsection 63A-1-202(2)(c), the language that states "using criteria established by
342 the board" is repealed;
343 (c) Section 63A-1-203 is repealed;
344 (d) Subsections 63A-1-204(1) and (2), the language that states "After consultation with
345 the board, and" is repealed; and
346 (e) Subsection 63A-1-204(1)(b), the language that states "using the standards provided
347 in Subsection 63A-1-203(3)(c)" is repealed.
348 (2) Subsection 63A-5-228(2)(h), relating to prioritizing and allocating capital
349 improvement funding, is repealed on July 1, 2024.
350 (3) Section 63A-5-603, State Facility Energy Efficiency Fund, is repealed July 1, 2023.
351 (4) Title 63C, Chapter 4a, Constitutional and Federalism Defense Act, is repealed July
352 1, 2028.
353 (5) Title 63C, Chapter 6, Utah Seismic Safety Commission, is repealed January 1,
354 2025.
355 (6) Title 63C, Chapter 16, Prison Development Commission Act, is repealed July 1,
356 2020.
357 (7) Title 63C, Chapter 17, Point of the Mountain Development Commission Act, is
358 repealed July 1, 2021.
359 (8) Title 63C, Chapter 18, Mental Health Crisis Line Commission, is repealed July 1,
360 2023.
361 (9) Title 63G, Chapter 21, Agreements to Provide State Services, is repealed July 1,
362 2025.
363 (10) Title 63H, Chapter 4, Heber Valley Historic Railroad Authority, is repealed July 1,
364 2020.
365 (11) In relation to the State Fair Corporation Board of Directors, on January 1, 2025:
366 (a) Subsection 63H-6-104(2)(c), related to a Senate appointment, is repealed;
367 (b) Subsection 63H-6-104(2)(d), related to a House appointment, is repealed;
368 (c) in Subsection 63H-6-104(2)(e), the language that states ", of whom only one may
369 be a legislator, in accordance with Subsection (3)(e)," is repealed;
370 (d) Subsection 63H-6-104(3)(a)(i) is amended to read:
371 "(3)(a)(i) Except as provided in Subsection (3)(a)(ii), a board member appointed under
372 Subsection (2)(e) or (f) shall serve a term that expires on the December 1 four years after the
373 year that the board member was appointed.";
374 (e) in Subsections 63H-6-104(3)(a)(ii), (c)(ii), and (d), the language that states "the
375 president of the Senate, the speaker of the House, the governor," is repealed and replaced with
376 "the governor"; and
377 (f) Subsection 63H-6-104(3)(e), related to limits on the number of legislators, is
378 repealed.
379 (12) Title 63H, Chapter 8, Utah Housing Corporation Act, is repealed July 1, 2026.
380 (13) Section 63M-7-212 is repealed on December 31, 2019.
381 (14) On July 1, 2025:
382 (a) in Subsection 17-27a-404(3)(c)(ii), the language that states "the Resource
383 Development Coordinating Committee," is repealed;
384 (b) Subsection 23-14-21(2)(c) is amended to read "(c) provide notification of proposed
385 sites for the transplant of species to local government officials having jurisdiction over areas
386 that may be affected by a transplant.";
387 (c) in Subsection 23-14-21(3), the language that states "and the Resource Development
388 Coordinating Committee" is repealed;
389 (d) in Subsection 23-21-2.3(1), the language that states "the Resource Development
390 Coordinating Committee created in Section 63J-4-501 and" is repealed;
391 (e) in Subsection 23-21-2.3(2), the language that states "the Resource Development
392 Coordinating Committee and" is repealed;
393 (f) Subsection 63J-4-102(1) is repealed and the remaining subsections are renumbered
394 accordingly;
395 (g) Subsections 63J-4-401(5)(a) and (c) are repealed;

405 (16) Subsection 63J-1-602.2(4), referring to dedicated credits to the Utah Marriage
406 Commission, is repealed July 1, 2023.
407 (17) Subsection 63J-1-602.2(5), referring to the Trip Reduction Program, is repealed
408 July 1, 2022.
409 (18) (a) Subsection [
410 Radio System Restricted Account, is repealed July 1, 2022.
411 (b) When repealing Subsection 63J-1-602.1(53), the Office of Legislative Research and
412 General Counsel shall, in addition to the office's authority under Subsection 36-12-12(3), make
413 necessary changes to subsection numbering and cross references.
414 (19) Subsection 63J-1-602.2(23), related to the Utah Seismic Safety Commission, is
415 repealed January 1, 2025.
416 (20) Subsection 63J-4-708(1), in relation to the Talent Ready Utah Board, on January
417 1, 2023, is amended to read:
418 "(1) On or before October 1, the board shall provide an annual written report to the
419 Social Services Appropriations Subcommittee and the Economic Development and Workforce
420 Services Interim Committee.".
421 (21) In relation to the Utah Substance Use and Mental Health Advisory Council, on
422 January 1, 2023:
423 (a) Sections 63M-7-301, 63M-7-302, 63M-7-303, 63M-7-304, and 63M-7-306 are
424 repealed;
425 (b) Section 63M-7-305, the language that states "council" is replaced with
426 "commission";
427 (c) Subsection 63M-7-305(1) is repealed and replaced with:
428 "(1) "Commission" means the Commission on Criminal and Juvenile Justice."; and
429 (d) Subsection 63M-7-305(2) is repealed and replaced with:
430 "(2) The commission shall:
431 (a) provide ongoing oversight of the implementation, functions, and evaluation of the
432 Drug-Related Offenses Reform Act; and
433 (b) coordinate the implementation of Section 77-18-1.1 and related provisions in

435 (22) The Crime Victim Reparations and Assistance Board, created in Section
436 63M-7-504, is repealed July 1, 2027.
437 (23) Title 63M, Chapter 11, Utah Commission on Aging, is repealed July 1, 2021.
438 (24) Subsection 63N-1-301(4)(c), related to the Talent Ready Utah Board, is repealed
439 on January 1, 2023.
440 (25) Title 63N, Chapter 2, Part 2, Enterprise Zone Act, is repealed July 1, 2028.
441 (26) (a) Title 63N, Chapter 2, Part 4, Recycling Market Development Zone Act, is
442 repealed January 1, 2021.
443 (b) Subject to Subsection (26)(c), Sections 59-7-610 and 59-10-1007 regarding tax
444 credits for certain persons in recycling market development zones, are repealed for taxable
445 years beginning on or after January 1, 2021.
446 (c) A person may not claim a tax credit under Section 59-7-610 or 59-10-1007:
447 (i) for the purchase price of machinery or equipment described in Section 59-7-610 or
448 59-10-1007, if the machinery or equipment is purchased on or after January 1, 2021; or
449 (ii) for an expenditure described in Subsection 59-7-610(1)(b) or 59-10-1007(1)(b), if
450 the expenditure is made on or after January 1, 2021.
451 (d) Notwithstanding Subsections (26)(b) and (c), a person may carry forward a tax
452 credit in accordance with Section 59-7-610 or 59-10-1007 if:
453 (i) the person is entitled to a tax credit under Section 59-7-610 or 59-10-1007; and
454 (ii) (A) for the purchase price of machinery or equipment described in Section
455 59-7-610 or 59-10-1007, the machinery or equipment is purchased on or before December 31,
456 2020; or
457 (B) for an expenditure described in Subsection 59-7-610(1)(b) or 59-10-1007(1)(b), the
458 expenditure is made on or before December 31, 2020.
459 (27) Section 63N-2-512 is repealed on July 1, 2021.
460 (28) (a) Title 63N, Chapter 2, Part 6, Utah Small Business Jobs Act, is repealed
461 January 1, 2021.
462 (b) Section 59-9-107 regarding tax credits against premium taxes is repealed for
463 calendar years beginning on or after January 1, 2021.
464 (c) Notwithstanding Subsection (28)(b), an entity may carry forward a tax credit in
465 accordance with Section 59-9-107 if:
466 (i) the person is entitled to a tax credit under Section 59-9-107 on or before December
467 31, 2020; and
468 (ii) the qualified equity investment that is the basis of the tax credit is certified under
469 Section 63N-2-603 on or before December 31, 2023.
470 (29) Subsections 63N-3-109(2)(e) and 63N-3-109(2)(f)(i) are repealed July 1, 2023.
471 (30) Title 63N, Chapter 4, Part 4, Rural Employment Expansion Program, is repealed
472 July 1, 2023.
473 (31) Title 63N, Chapter 9, Part 2, Outdoor Recreational Infrastructure Grant Program,
474 is repealed January 1, 2023.
475 (32) In relation to the Pete Suazo Utah Athletic Commission, on January 1, 2021:
476 (a) Subsection 63N-10-201(2)(a) is amended to read:
477 "(2) (a) The governor shall appoint five commission members with the advice and
478 consent of the Senate.";
479 (b) Subsection 63N-10-201(2)(b), related to legislative appointments, is repealed;
480 (c) in Subsection 63N-10-201(3)(a), the language that states ", president, or speaker,
481 respectively," is repealed; and
482 (d) Subsection 63N-10-201(3)(d) is amended to read:
483 "(d) The governor may remove a commission member for any reason and replace the
484 commission member in accordance with this section.".
485 (33) In relation to the Talent Ready Utah Board, on January 1, 2023:
486 (a) Subsection 9-22-102(16) is repealed;
487 (b) in Subsection 9-22-114(2), the language that states "Talent Ready Utah," is
488 repealed; and
489 (c) in Subsection 9-22-114(5), the language that states "representatives of Talent Ready
490 Utah," is repealed.
491 (34) Title 63N, Chapter 12, Part 5, Talent Ready Utah Center, is repealed January 1,
492 2023.
493 Section 5. Section 63I-2-263 is amended to read:
494 63I-2-263. Repeal dates, Title 63A to Title 63N.
495 (1) On July 1, 2020:
496 (a) Subsection 63A-1-203(5)(a)(i) is repealed; and
497 (b) in Subsection 63A-1-203(5)(a)(ii), the language that states "appointed on or after
498 May 8, 2018," is repealed.
499 (2) Sections 63C-4a-307 and 63C-4a-309 are repealed January 1, 2020.
