7 LONG TITLE
8 General Description:
9 This joint resolution of the Legislature supports contracting for beds for state inmates at
10 the Emery County correctional facility.
11 Highlighted Provisions:
12 This resolution:
13 ▸ supports jail expansion as beneficial to both the state and the counties through a
14 contract with the Department of Corrections; and
15 ▸ approves contracting for beds dedicated to housing inmates in Emery County.

19 Be it resolved by the Legislature of the state of Utah:
20 WHEREAS, counties in Utah contract with the Department of Corrections to provide
21 prison bed space for state prisoners;
22 WHEREAS, this contracting arrangement has proved beneficial to both the state and
23 the counties that saved taxpayers from the burden of building new state correctional facilities
24 while, at the same time, assisting counties to meet their own correctional space needs;
25 WHEREAS, in accordance with Utah Code Annotated Subsection 64-13e-103(6), the
26 Department of Corrections may not enter into a contract with a county to house state inmates
27 unless the Legislature has previously passed a joint resolution that includes the approximate
28 number of beds to be contracted, the final state daily incarceration rate, the approximate
29 amount of a county's long term debt, and the repayment time of the debt for the facility where
30 inmates are to be housed;
31 WHEREAS, the Department of Corrections is authorized to contract for 50 beds in
32 addition to the current 10 beds, in Emery County;
33 WHEREAS, the state daily incarceration rate that the Department of Corrections will
34 pay the county per inmate is currently $53.39 per day;
35 WHEREAS, the facility that would house the inmates in Emery County has no facility
36 debt;
37 WHEREAS, Emery County has sufficient facilities and beds to accommodate state
38 inmates and has met the requirements of the Utah Code Annotated Subsection 64-13e-103(6);
39 and
40 WHEREAS, contracting with the Department of Corrections for additional jail bed
41 space would assist the state in addressing projected bed space and treatment needs, and Emery
42 County's efforts to have sufficient capacity to house the Department of Corrections' jail
43 populations:
44 NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah
45 approves contracting for beds in the correctional facility located in Emery County in the
46 amount specified in this resolution.
47 BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Emery
48 County Commission and the Department of Corrections.
