7     LONG TITLE
8     General Description:
9          This bill provides for an annual increase in the value of the weighted pupil unit.
10     Highlighted Provisions:
11          This bill:
12          ▸     provides for an annual increase in the value of the weighted pupil unit in the Public
13     Education Base Budget until a certain cumulative amount; and
14          ▸     makes technical changes.
15     Money Appropriated in this Bill:

24     Be it enacted by the Legislature of the state of Utah:
25          Section 1. Section 53F-9-201.1 (Contingently Effective 01/01/21) is amended to read:
26          53F-9-201.1 (Contingently Effective 01/01/21). Appropriations to the Minimum
27     School Program from the Uniform School Fund.

28          (1) As used in this section:
29          (a) "Base budget" means the same as that term is defined in legislative rule.
30          (b) "Enrollment growth and inflation estimates" means the cost estimates regarding
31     enrollment growth and inflation described in Section 53F-2-208.
32          (2) Except as provided in Subsection 53F-9-204(3), for a fiscal year beginning on or
33     after July 1, 2021, when preparing the Public Education Base Budget, the Office of the
34     Legislative Fiscal Analyst shall:
35          (a) include appropriations to the Minimum School Program from the Uniform School
36     Fund, and, subject to Subsection 53F-9-204(3), the Public Education Economic Stabilization
37     Restricted Account, in an amount that is greater than or equal to the sum of:
38          [(a)] (i) the ongoing Education Fund and Uniform School Fund appropriations to the
39     Minimum School Program in the current fiscal year; and
40          [(b)] (ii) subject to Subsection 53F-9-204(3)(b), enrollment growth and inflation
41     estimates[.]; and
42          (b) except as provided in Subsection (4), an appropriation to increase the value of the
43     weighted pupil unit that is greater than or equal to 10% of the difference between, as
44     determined by the Office of the Legislative Fiscal Analyst:
45          (i) the estimated amount of ongoing Education Fund and Uniform School Fund
46     revenue available for the Legislature to appropriate for the next fiscal year; and
47          (ii) the amount of ongoing appropriations from the Education Fund and Uniform
48     School Fund in the current fiscal year.
49          (3) The total annual amount deposited into the Uniform School Fund, including the
50     deposits through the distributions described in Sections 59-7-532 and 59-10-544, for a given
51     fiscal year may not exceed the amount appropriated from the Uniform School Fund for that
52     fiscal year.
53          (4) (a) If an appropriation to increase the value of the weighted pupil unit described in
54     Subsection (2)(b) would cause the cumulative amount of increases to the value of the weighted
55     pupil unit, beginning for fiscal year 2022, to exceed $140,500,000, the Office of the Legislative
56     Fiscal Analyst:
57          (i) shall include in the Public Education Base Budget an appropriation to increase the
58     value of the weighted pupil unit that would cause the cumulative amount of increases to equal

59     $140,500,000; and
60          (ii) is exempt from future application of Subsection (2)(b).
61          (b) Nothing in this section limits the Legislature's ability to appropriate additional
62     amounts to increase the value of the weighted pupil unit.
