8     LONG TITLE
9     General Description:
10          This joint resolution approves a purchase of specific real properties.
11     Highlighted Provisions:
12          This resolution:
13          ▸     approves the purchase by the Division of Facilities Construction and Management
14     of certain real properties.
15     Special Clauses:
16          None

18     Be it resolved by the Legislature of the state of Utah:
19          WHEREAS, gasoline from a state fuel network site at the Salt Lake Community
20     College leaked into the aquifer and affected two adjoining real properties identified by the
21     Department of Environmental Quality;
22          WHEREAS, attempts to coordinate cleanup with the various parties have failed;
23          WHEREAS, the Department of Administrative Services proposes that the Division of
24     Facilities Construction and Management (DFCM) purchase the two real properties affected
25     with money from the Division of Fleet Operations and coordinate the cleanup;
26          WHEREAS, once DFCM cleans up the real properties of the hazardous materials, the
27     real properties could be sold and the proceeds returned to the Division of Fleet Operations,
28     minus any costs to DFCM for the remediation;
29          WHEREAS, pursuant to Section 63A-5b-303, the DFCM may, without legislative

30     approval, acquire title to real property for use by the state or an agency if the acquisition cost
31     does not exceed $250,000; and
32          WHEREAS, the purchase of the real properties would cost approximately $650,000 and
33     therefore require legislative approval:
34          NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah
35     approves the purchase by DFCM of the two real properties affected by gasoline from a state
36     fuel network site at Salt Lake Community College that leaked into the aquifer for
37     approximately $650,000.
