8     LONG TITLE
9     General Description:
10          This bill modifies provisions of the Cosmetology and Associated Professions Licensing
11     Act.
12     Highlighted Provisions:
13          This bill:
14          ▸     provides that certain licensed cosmetology and associated professions schools may
15     offer 50% of their instruction online;
16          ▸     provides a sunset date; and
17          ▸     makes technical changes.
18     Money Appropriated in this Bill:
19          None
20     Other Special Clauses:
21          This bill provides a special effective date.

27     Be it enacted by the Legislature of the state of Utah:
28          Section 1. Section 58-11a-302.5 is amended to read:
29          58-11a-302.5. Online curriculum for a licensed school.

30          [(1) An applicant for licensure as an esthetics school under Subsection 58-11a-302(13)
31     and an] A barber school, cosmetology/barber school, electrologist school, esthetics school, hair
32     design school, or nail technology school licensed under this chapter may offer up to [30% of its
33     total] 50% of the school's total per program curriculum online[: (a) for instruction in theory;
34     and (b)] in accordance with standards adopted by an applicable nationally recognized
35     accrediting [organizations] organization.
36          [(2) The provisions of this section do not:]
37          [(a) require the board to allow other schools licensed under this chapter to offer
38     curriculum online; or]
39          [(b) limit the authority of the board to allow other schools licensed under this chapter
40     to offer curriculum online.]
41          Section 2. Section 63I-1-258 is amended to read:
42          63I-1-258. Repeal dates, Title 58.
43          (1) Section 58-3a-201, which creates the Architects Licensing Board, is repealed July
44     1, 2026.
45          (2) Section 58-11a-302.5 is repealed July 1, 2022.
46          [(2)] (3) Title 58, Chapter 13, Health Care Providers Immunity from Liability Act, is
47     repealed July 1, 2026.
48          [(3)] (4) Title 58, Chapter 15, Health Facility Administrator Act, is repealed July 1,
49     2025.
50          [(4)] (5) Title 58, Chapter 20b, Environmental Health Scientist Act, is repealed July 1,
51     2028.
52          [(5) Section 58-37-4.3 is repealed January 1, 2020.]
53          (6) Subsection 58-37-6(7)(f)(iii) is repealed July 1, 2022, and the Office of Legislative
54     Research and General Counsel is authorized to renumber the remaining subsections
55     accordingly.
56          (7) Title 58, Chapter 40, Recreational Therapy Practice Act, is repealed July 1, 2023.
57          (8) Title 58, Chapter 41, Speech-Language Pathology and Audiology Licensing Act, is

58     repealed July 1, 2029.
59          (9) Title 58, Chapter 42a, Occupational Therapy Practice Act, is repealed July 1, 2025.
60          (10) Title 58, Chapter 46a, Hearing Instrument Specialist Licensing Act, is repealed
61     July 1, 2023.
62          (11) Title 58, Chapter 47b, Massage Therapy Practice Act, is repealed July 1, 2024.
63          (12) Subsection 58-55-201(2), which creates the Alarm System and Security Licensing
64     Advisory Board, is repealed July 1, 2027.
65          (13) Subsection 58-60-405(3), regarding certain educational qualifications for licensure
66     and reporting, is repealed July 1, 2022.
67          (14) Title 58, Chapter 61, Part 7, Behavior Analyst Licensing Act, is repealed July 1,
68     2026.
69          (15) Title 58, Chapter 72, Acupuncture Licensing Act, is repealed July 1, 2027.
70          (16) Title 58, Chapter 86, State Certification of Commercial Interior Designers Act, is
71     repealed July 1, 2021.
72          (17) The following sections are repealed on July 1, 2022:
73          (a) Section 58-5a-502;
74          (b) Section 58-31b-502.5;
75          (c) Section 58-67-502.5;
76          (d) Section 58-68-502.5; and
77          (e) Section 58-69-502.5.
78          Section 3. Effective date.
79          If approved by two-thirds of all the members elected to each house, this bill takes effect
80     upon approval by the governor, or the day following the constitutional time limit of Utah
81     Constitution, Article VII, Section 8, without the governor's signature, or in the case of a veto,
82     the date of veto override.
