7     LONG TITLE
8     General Description:
9          This bill amends provisions relating to the Department of Health.
10     Highlighted Provisions:
11          This bill:
12          ▸     amends the qualifications and other provisions relating to the executive director of
13     the Department of Health.
14     Money Appropriated in this Bill:

16     Other Special Clauses:
17          This bill provides a special effective date.

22     Be it enacted by the Legislature of the state of Utah:
23          Section 1. Section 26-1-9 is amended to read:
24          26-1-9. Executive director -- Qualifications.
25          (1) Except as provided in Subsection (2), the executive director shall be a physician
26     who is a graduate of a regularly chartered and legally constituted medical school, licensed to
27     practice medicine and surgery in all branches in the state, who has successfully completed:
28          (a) a master's degree of public health from an accredited school of public health or

29     from an accredited program of public health and has at least three years professional full-time
30     experience in a senior level administrative capacity; or
31          (b) at least one year's graduate work in an accredited school of public health and has at
32     least five years professional full-time experience, of which at least three years have been in
33     public health in a senior level administrative capacity.
34          (2) If the executive director is not a physician under Subsection (1), the executive
35     director shall:
36          (a) (i) have successfully completed at least a master's degree of public health or public
37     administration from an accredited school of public health or from an accredited program of
38     public health or public administration; and
39          (ii) have at least five years of professional full-time experience, of which at least two
40     years have been in public health in a senior level administrative capacity; or
41          (b) have at least [seven] five years of professional full-time experience in public health
42     programs, of which at least [five] three years have been in a senior level administrative
43     capacity.
44          (3) An executive director shall be thoroughly informed and experienced in all aspects
45     of public health work.
46          (4) If the executive director is not a physician[, the]:
47          (a) a deputy director of the department shall [be a physician who has] have:
48          (i) successfully completed at least one year's graduate work in an accredited school of
49     public health or an accredited program of public health[.]; and
50          (ii) at least five years of professional full-time experience in public health programs;
51     and
52          (b) if the individual described in Subsection (4)(a) is not a physician licensed to
53     practice medicine in the state, a deputy director of the department shall be a physician who has
54     experience in public health and is licensed to practice medicine in the state.
55          Section 2. Effective date.

56          If approved by two-thirds of all the members elected to each house, this bill takes effect
57     upon approval by the governor, or the day following the constitutional time limit of Utah
58     Constitution, Article VII, Section 8, without the governor's signature, or in the case of a veto,
59     the date of veto override.
