7     LONG TITLE
8     General Description:
9          This bill addresses funding related to laboratory equipment in the Department of
10     Agriculture and Food.
11     Highlighted Provisions:
12          This bill:
13          ▸     creates the Department of Agriculture and Food Laboratory Equipment Fund;
14          ▸     outlines the source of money in the fund;
15          ▸     addresses restrictions on the use of the fund; and
16          ▸     imposes a cap on money in the fund.
17     Money Appropriated in this Bill:

19     Other Special Clauses:
20          This bill provides a special effective date.

25     Be it enacted by the Legislature of the state of Utah:
26          Section 1. Section 4-2-203 is enacted to read:
27          4-2-203. Department of Agriculture and Food Laboratory Equipment Fund.
28          (1) There is created an expendable special revenue fund known as the "Department of
29     Agriculture and Food Laboratory Equipment Fund," which is referred to in this section as the

30     "fund."
31          (2) The fund consists of:
32          (a) collections the Division of Laboratories within the department receives under this
33     title that are not expended during the previous fiscal year;
34          (b) appropriations from the Legislature; and
35          (c) interest and earnings on the fund.
36          (3) The state treasurer shall invest the money in the fund according to Title 51, Chapter
37     7, State Money Management Act, except that interest or other earnings derived from those
38     investments shall be deposited into the fund.
39          (4) (a) The department may use money in the fund only to pay for the repair,
40     replacement, or upgrade of laboratory equipment in accordance with this section.
41          (5) The state chemist or the commissioner shall approve expenditures from the fund for
42     laboratory equipment repair, replacement, or upgrade as follows:
43          (a) the state chemist may approve using money in the fund to repair, replace, or
44     upgrade laboratory equipment if the amount to be expended is less than $10,000; and
45          (b) the state chemist shall obtain the approval of the commissioner for using money in
46     the fund to repair, replace, or upgrade laboratory equipment if the amount to be expended
47     equals or exceeds $10,000.
48          (6) (a) Subject to the other provisions of this Subsection (6), the Division of Finance
49     shall deposit into the fund the collections that the Division of Laboratories receives under this
50     title that are not expended during a fiscal year.
51          (b) The fund may not exceed $500,000 at the end of a fiscal year.
52          (c) If the fund exceeds $500,000 at the end of the fiscal year, the Division of Finance
53     shall deposit into the General Fund the money in excess of the amount necessary to maintain
54     the fund balance at $500,000.
55          Section 2. Effective date.
56          This bill takes effect on July 1, 2021.
