8 LONG TITLE
9 General Description:
10 This bill requires the State Board of Education (state board) to review reports required
11 in statute and rule.
12 Highlighted Provisions:
13 This bill:
14 ▸ requires the State Board of Education (state board) to:
15 • work with local education agencies to develop a process to review reports
16 required in statute and state board rule; and
17 • in reviewing required reports, take into consideration several factors, including
18 the time and cost to complete a required report, and whether the information,
19 accountability, or transparency the required report provides could be obtained or
20 achieved by other means;
21 ▸ permits the state board to make recommendations to the Legislature for legislation;
22 and
23 ▸ defines terms.

32 Be it enacted by the Legislature of the state of Utah:
33 Section 1. Section 53E-3-523 is enacted to read:
34 53E-3-523. State board to review reporting requirements.
35 (1) As used in this section, "required report" means a report that statute or state board
36 rule requires an LEA or the state board to make.
37 (2) (a) The state board shall work with LEAs to develop a process to review required
38 reports.
39 (b) The process described in Subsection (2)(a) shall include the following
40 considerations for each required report:
41 (i) (A) the required report's purpose; and
42 (B) the report's effectiveness in accomplishing the report's purpose;
43 (ii) which entity requires the required report;
44 (iii) which entity created the report requirements;
45 (iv) which entity or individual reviews the required report;
46 (v) whether the information in the required report is otherwise available or could be
47 obtained another way;
48 (vi) whether the required report is the least burdensome way to collect the information
49 in the required report;
50 (vii) whether accountability or transparency could be achieved through a means other
51 than the required report;
52 (viii) whether and how the Utah Schools Information Management System affects the
53 required report;
54 (ix) the estimated time and cost required to complete the required report for:
55 (A) an LEA; or
56 (B) the state board; and
57 (x) the amount of appropriated program funding available for program purposes after
58 program money is expended for completing a required report for the program.
59 (3) After reviewing required reports as described in Subsection (2), the state board may
60 make recommendations for legislation to the Legislature.
