9 General Description:
10 This bill addresses the development of a statewide aquatic invasive species emergency
11 response plan.
12 Highlighted Provisions:
13 This bill:
14 ▸ defines terms;
15 ▸ requires the Division of Wildlife Resources to:
16 • develop a statewide aquatic invasive species emergency response plan aimed at
17 remediating the spread of aquatic invasive species throughout the state;
18 • present the statewide aquatic invasive species emergency response plan, any
19 proposed legislation to effectuate the plan, and an estimate of the cost to
20 effectuate the plan, to the Legislature for consideration; and
21 • report to the Legislature on any events that require implementation of the plan.

30 Be it enacted by the Legislature of the state of Utah:
31 Section 1. Section 23-27-501 is enacted to read:

33 23-27-501. Aquatic Invasive Species Emergency Response Plan.
34 (1) As used in this section:
35 (a) "Committee" means the Natural Resources, Agriculture, and Environment Interim
36 Committee.
37 (b) "Emergency response plan" means the statewide aquatic invasive species
38 emergency response plan developed by the division in accordance with this part.
39 (2) The division shall develop a statewide aquatic invasive species emergency response
40 plan to address the potential spread of aquatic invasive species throughout the state.
41 (3) In developing the emergency response plan, the division shall coordinate with
42 public and private entities that may be necessary or helpful to remediating the potential spread
43 of aquatic invasive species throughout the state.
44 (4) The emergency response plan shall:
45 (a) designate the division as the entity that will coordinate the implementation of the
46 emergency response plan;
47 (b) provide for annual review of the emergency response plan by the division;
48 (c) provide that the emergency response plan may only be implemented if the division
49 detects aquatic invasive species, including Dreissena mussels, at a water body, facility, or water
50 supply system within the state; and
51 (d) define what constitutes a detection of aquatic invasive species at a water body,
52 facility, or water supply system.
53 (5) On or before August 1, 2021, the division shall submit to the committee the
54 following:
55 (a) the emergency response plan;
56 (b) proposed legislation that may be necessary to effectuate the emergency response
57 plan or to increase the effectiveness of the emergency response plan; and
58 (c) an analysis and estimate of the cost to implement the emergency response plan.
59 (6) After receiving the items described in Subsection (5), the committee may:
60 (a) recommend to the Legislature that the plan be implemented;
61 (b) return the plan to the division for further study and evaluation;
62 (c) draft legislation proposed or requested by the division; or
63 (d) take action to further the funding of the emergency response plan.
64 (7) If an event requires the implementation of the emergency response plan, the
65 division shall report on that event and the implementation of the emergency response plan to
66 the committee.
