8 General Description:
9 This bill authorizes the creation of Criminal Code Changes Impact Statements.
10 Highlighted Provisions:
11 This bill:
12 ▸ requires the Utah Sentencing Commission to create Criminal Code Changes Impact
13 Statements upon requests from a legislator; and
14 ▸ requires that impact statements include an estimate of how criminal justice-related
15 legislation may impact certain demographics of the population.

24 Be it enacted by the Legislature of the state of Utah:
25 Section 1. Section 63M-7-407 is enacted to read:
26 63M-7-407. Criminal Code Changes Impact Statement.
27 (1) Upon request by a member of the Legislature, a Criminal Code Changes Impact
28 Statement shall be prepared by the commission with respect to certain bills and amendments
29 that could, if passed, increase or decrease the number of criminal convictions or the inmate
30 population of the correctional facilities in this state.
31 (2) When a request is made pursuant to Subsection (1), the commission shall prepare a
32 Criminal Code Changes Impact Statement:
33 (a) within two business days of receipt if the request is made while the Legislature is in
34 session; or
35 (b) within 10 business days of receipt if the request is made while the Legislature is not
36 in session.
37 (3) The Criminal Code Changes Impact Statement shall include:
38 (a) the estimated number of criminal cases per year that the legislation may affect; and
39 (b) an estimate of how the proposed legislation would change the following
40 demographics of the criminal offender population:
41 (i) race;
42 (ii) ethnicity;
43 (iii) sex;
44 (iv) age;
45 (v) sexual orientation;
46 (vi) gender identity; and
47 (vii) disability.
48 (4) If the commission does not have ready access to the demographic information
49 required for the report, the commission shall indicate on the report:
50 (a) which demographic population lacks sufficient data; and
51 (b) why the commission does not have access to sufficient data regarding that
52 demographic population.
