7     LONG TITLE
8     General Description:
9          This bill addresses the taking of wildlife.
10     Highlighted Provisions:
11          This bill:
12          ▸     imposes notice requirements unless certain circumstances exist; and
13          ▸     makes technical changes.

22     Be it enacted by the Legislature of the state of Utah:
23          Section 1. Section 23-13-6 is amended to read:
24          23-13-6. Taking of wildlife by division.
25          [The Division of Wildlife resources]
26          (1) Subject to the other provisions of this section, the division may take wildlife of any
27     kind from any place and in any manner for purposes [deemed] considered by the director of the

28     division to be in the interest of wildlife conservation.
29          (2) The division shall deliver notice to an affected landowner or an agent of an affected
30     landowner, either in writing or orally, before the taking of wildlife on privately owned land
31     under this section. The division may take the wildlife immediately after or at a time reasonably
32     required for the taking after delivering notice.
33          (3) The notice requirements in Subsection (2) do not apply in a situation when there is
34     a threat to public safety or exigent circumstances exist.
