7     LONG TITLE
8     General Description:
9          This bill creates a working group to study harm reduction oriented strategies to reduce
10     overdose injuries and deaths in the state.
11     Highlighted Provisions:
12          This bill:
13          ▸     directs the Utah Substance Abuse Advisory Council to convene a working group to
14     study harm reduction oriented strategies to reduce overdose injuries and deaths;
15          ▸     describes the purpose and membership of the working group; and
16          ▸     creates a reporting requirement and a sunset date.

27     Be it enacted by the Legislature of the state of Utah:
28          Section 1. Section 63I-2-263 is amended to read:
29          63I-2-263. Repeal dates, Title 63A to Title 63N.
30          (1) On July 1, 2020:
31          (a) Subsection 63A-1-203(5)(a)(i) is repealed; and
32          (b) in Subsection 63A-1-203(5)(a)(ii), the language that states "appointed on or after
33     May 8, 2018," is repealed.
34          (2) Section 63A-3-111 is repealed June 30, 2021.
35          (3) Title 63C, Chapter 19, Higher Education Strategic Planning Commission is
36     repealed July 1, 2021.
37          (4) Title 63C, Chapter 22, Digital Wellness, Citizenship, and Safe Technology
38     Commission is repealed July 1, 2023.
39          (5) The following sections regarding the World War II Memorial Commission are
40     repealed on July 1, 2022:
41          (a) Section 63G-1-801;
42          (b) Section 63G-1-802;
43          (c) Section 63G-1-803; and
44          (d) Section 63G-1-804.
45          (6) Subsections 63G-6a-802(1)(d) and 63G-6a-802(3)(b)(iii), regarding a procurement
46     relating to a vice presidential debate, are repealed January 1, 2021.
47          [(7) In relation to the State Fair Park Committee, on January 1, 2021:]
48          [(a) Section 63H-6-104.5 is repealed; and]
49          [(b) Subsections 63H-6-104(8) and (9) are repealed.]
50          [(8)] (7) Section 63H-7a-303 is repealed July 1, 2024.
51          [(9)] (8) Subsection 63J-1-206(3)(c), relating to coronavirus, is repealed July 1, 2021.
52          [(10)] (9) In relation to the Employability to Careers Program Board, on July 1, 2022:
53          (a) Subsection 63J-1-602.1(57) is repealed;
54          (b) Subsection 63J-4-301(1)(h), related to the review of data and metrics, is repealed;
55     and
56          (c) Title 63J, Chapter 4, Part 7, Employability to Careers Program, is repealed.

57          (10) Section 63M-1-303.1 is repealed on January 1, 2022.
58          (11) Title 63M, Chapter 4, Part 8, Voluntary Home Energy Information Pilot Program
59     Act, is repealed January 1, 2022.
60          (12) Sections 63M-7-213 and 63M-7-213.5 are repealed on January 1, 2023.
61          (13) Subsection 63N-12-508(3) is repealed December 31, 2021.
62          (14) Title 63N, Chapter 13, Part 3, Facilitating [Public-Private] Public-private
63     Partnerships Act, is repealed January 1, 2024.
64          (15) Title 63N, Chapter 15, COVID-19 Economic Recovery Programs, is repealed
65     December 31, 2021.
66          Section 2. Section 63M-1-303.1 is enacted to read:
67          63M-1-303.1. Working group to study strategies for overdose harm reduction.
68          (1) The council shall convene a working group to study harm reduction oriented
69     strategies to address overdose injuries and deaths, including the feasibility of establishing:
70          (a) a pilot program for an overdose prevention site; and
71          (b) a mobile unit to increase access to certain medication-assisted therapies for
72     vulnerable or marginalized areas and populations.
73          (2) The working group convened under Subsection (1) shall include representation
74     from at least the following groups:
75          (a) family members impacted by drug overdose;
76          (b) recovery community advocates;
77          (c) a local elected official;
78          (d) local law enforcement;
79          (e) local fire department;
80          (f) local prosecutors;
81          (g) local treatment providers;
82          (h) a member from the council;
83          (i) a representative from the Utah Division of Substance Abuse and Mental Health;
84          (j) a representative from the Department of Health;
85          (k) a representative of a local health department;
86          (l) a representative of local governments in the state; and
87          (m) other community members as needed.

88          (3) On or before November 17, 2021, the working group convened under Subsection
89     (1) shall report to the Health and Human Services Interim Committee strategies and proposals
90     for legislative changes to reduce overdose injuries and deaths through harm reduction oriented
91     strategies, including the feasibility of establishing:
92          (a) a pilot program for an overdose prevention site; and
93          (b) a mobile unit to increase access to certain medication-assisted therapies for
94     vulnerable or marginalized areas and populations.
