8 General Description:
9 This bill creates a pilot program to address issues related to pollinators.
10 Highlighted Provisions:
11 This bill:
12 ▸ directs the Department of Agriculture and Food to create a pollinator pilot program;
13 ▸ permits the department to coordinate with entities related to the pilot program;
14 ▸ authorizes rulemaking;
15 ▸ enacts a sunset date; and
16 ▸ makes technical changes.

29 Be it enacted by the Legislature of the state of Utah:
30 Section 1. Section 4-2-701 is enacted to read:

32 4-2-701. Pollinator pilot program.
33 (1) Subject to the other provisions of this section, the department shall implement a
34 three-year pollinator pilot program that includes one or more of the following:
35 (a) public education efforts that include workshops, planting guides, or a public
36 education campaign to raise awareness about creating pollinator habitats;
37 (b) distribution of pollinator-friendly native flowering plants or seeds for native
38 flowering plants for planting within the state to protect a diversity of pollinators;
39 (c) pollinator programs run by local governments and nonprofit organizations with
40 support from the department; and
41 (d) grants that:
42 (i) are provided on a first-come-first-serve basis; and
43 (ii) cover up to 25% of the costs for the planting of pollinator-friendly native flowering
44 plants or seeds for native flowering plants on private or public land.
45 (2) (a) The cost to the department related to the native flowering plants or seeds
46 described in Subsection (1) may not exceed $100,000 in a fiscal year.
47 (b) The department may coordinate with the federal government, other state agencies,
48 state institutions of higher education, or political subdivisions to provide for the activities
49 described in Subsection (1).
50 (c) The department may designate smaller areas of the state to begin the activities
51 described in Subsection (1).
52 (3) The department may make rules, in accordance with Title 63G, Chapter 3, Utah
53 Administrative Rulemaking Act, to establish:
54 (a) the criteria for receiving a grant under this section; and
55 (b) the process to apply for and receive a grant under this section.
56 Section 2. Section 63I-1-204 is amended to read:
57 63I-1-204. Repeal dates, Title 4.
58 (1) Section 4-2-108, which creates the Agricultural Advisory Board, is repealed July 1,
59 2023.
60 (2) Title 4, Chapter 2, Part 7, Pollinator Pilot Program, is repealed July 1, 2024.

73 Section 3. Appropriation.
74 The following sums of money are appropriated for the fiscal year beginning July 1,
75 2021, and ending June 30, 2022. These are additions to amounts previously appropriated for
76 fiscal year 2022. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
77 Act, the Legislature appropriates the following sums of money from the funds or accounts
78 indicated for the use and support of the government of the state of Utah.

84 It is the intent of the Legislature that the appropriations in this item be used to assist
85 with the implementation of the pollinator pilot program enacted in Section 4-2-701.
