10     LONG TITLE
11     General Description:
12          This bill addresses the creation of Utahraptor State Park and Lost Creek State Park.
13     Highlighted Provisions:
14          This bill:
15          ▸     authorizes the Division of Parks and Recreation to use portions of the Dalton Wells
16     area as a state park;
17          ▸     provides that Utahraptor State Park shall be considered part of the state parks
18     system;
19          ▸     authorizes the Division of Parks and Recreation to enter into an agreement with the
20     Bureau of Reclamation to use Lost Creek Reservoir as a state park; and
21          ▸     provides that Lost Creek State Park shall be considered part of the state parks
22     system when the division enters into an agreement with the bureau.
23     Money Appropriated in this Bill:
24          This bill appropriates in fiscal year 2022:

25          ▸     to the Department of Natural Resources, as a one-time appropriation:
26               •     from the General Fund, One-time, $36,500,000.

34     Be it enacted by the Legislature of the state of Utah:
35          Section 1. Section 79-4-607 is enacted to read:
36          79-4-607. Utahraptor State Park.
37          (1) As used in this section, "Dalton Wells" means the land located in the area known as
38     Dalton Wells and fully described by the map and legal description on file with the division.
39          (2) The division may:
40          (a) receive donations of land or facilities in the Dalton Wells area for the creation of,
41     and inclusion within, Utahraptor State Park;
42          (b) engage in land transfers for land in the Dalton Wells area for inclusion in
43     Utahraptor State Park; or
44          (c) purchase land or facilities in the Dalton Wells area for inclusion in Utahraptor State
45     Park.
46          (3) Utahraptor State Park shall be included within the state park system.
47          (4) The division may not open Utahraptor State Park to the public for use as a state
48     park until the division has received sufficient funding from the State Building Board or from
49     the General Fund to provide for capital improvements and any necessary land acquisitions.
50          (5) Land acquisitions and capital investments will be made at the park in a way that
51     allows Utahraptor State Park to remain financially self-sustaining.
52          (6) Ongoing operations at Utahraptor State Park shall be funded through the Division
53     of Parks and Recreation's restricted fees account.
54          Section 2. Section 79-4-608 is enacted to read:
55          79-4-608. Lost Creek State Park.

56          (1) As used in this section, the "Lost Creek area" means the Lost Creek Reservoir and
57     certain land around the reservoir, fully described by the map and legal description on file with
58     the division.
59          (2) The division may enter into an agreement with the United States Bureau of
60     Reclamation to manage recreational operations at Lost Creek Reservoir and to use the Lost
61     Creek area as a state park.
62          (3) Upon the division entering into an agreement described in Subsection (2), the Lost
63     Creek area shall be included within the state park system as Lost Creek State Park.
64          (4) Hunting wildlife in Lost Creek State Park is limited to waterfowl only.
65          Section 3. Appropriation.
66          The following sums of money are appropriated for the fiscal year beginning July 1,
67     2021, and ending June 30, 2022. These are additions to amounts previously appropriated for
68     fiscal year 2022. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
69     Act, the Legislature appropriates the following sums of money from the funds or accounts
70     indicated for the use and support of the government of the state of Utah.

76          Under Section 63J-1-603, the Legislature intends that appropriations provided under
77     this item not lapse at the close of fiscal year 2022. The use of any nonlapsing funds is limited
78     to the development of Utahraptor State Park and Lost Creek State Park. The Legislature intends
79     that up to $7,500,000 be used to acquire land in the Dalton Wells area for inclusion in
80     Utahraptor State Park.
