7     LONG TITLE
8     General Description:
9          This bill creates the Children's Health Care Coverage Program.
10     Highlighted Provisions:
11          This bill:
12          ▸     amends provisions relating to outreach to promote health insurance coverage for
13     children;
14          ▸     creates the Children's Health Care Coverage Program;
15          ▸     describes the purposes of the program created in this bill;
16          ▸     creates the Children's Health Care Coverage Program Restricted Account; and
17          ▸     establishes a sunset date.
18     Money Appropriated in this Bill:
19          This bill appropriates in fiscal year 2022:
20          ▸     to General Fund Restricted - Children's Health Care Coverage Program Restricted
21     Account, as an ongoing appropriation:
22               •     from the General Fund, Ongoing, $172,500.

37     Be it enacted by the Legislature of the state of Utah:
38          Section 1. Section 26-18-15 is amended to read:
39          26-18-15. Process to promote health insurance coverage for children.
40          (1) The department, in collaboration with the Department of Workforce Services[,] and
41     the State Board of Education, [and the department shall: (a) collaborate with one another to]
42     shall develop a process to promote health insurance coverage for a child in school when:
43          [(i)] (a) the child applies for free or reduced price school lunch;
44          [(ii)] (b) a child enrolls in or registers in school; and
45          [(iii)] (c) other appropriate school related opportunities[;].
46          [(b) report to the Legislature on the development of the process under Subsection (1)(a)
47     no later than November 19, 2008; and]
48          [(c) implement the process developed under Subsection (1)(a) no later than the
49     2009-10 school year.]
50          (2) The department, in collaboration with the Department of Workforce Services, shall
51     promote and facilitate the enrollment of children identified under Subsection (1)[(a)] without
52     health insurance in the Utah Children's Health Insurance Program, the Medicaid program, or
53     the Utah Premium Partnership for Health Insurance Program.
54          Section 2. Section 26-18-27 is enacted to read:
55          26-18-27. Children's Health Care Coverage Program -- Restricted Account.
56          (1) As used in this section:
57          (a) "Account" means the Children's Health Care Coverage Program Restricted Account
58     created in Subsection (4).

59          (b) "CHIP" means the Children's Health Insurance Program created in Section
60     26-40-103.
61          (c) "Program" means the Children's Health Care Coverage Program created in
62     Subsection (2).
63          (2) (a) There is created the Children's Health Care Coverage Program within the
64     department.
65          (b) The purpose of the program is to:
66          (i) promote health insurance coverage for children in accordance with Section
67     26-18-15;
68          (ii) conduct research regarding families who are eligible for Medicaid and CHIP to
69     determine awareness and understanding of available coverage;
70          (iii) analyze trends in disenrollment and identify reasons that families may not be
71     renewing enrollment, including any barriers in the process of renewing enrollment;
72          (iv) administer surveys to recently enrolled CHIP and children's Medicaid enrollees to
73     identify:
74          (A) how the enrollees learned about coverage; and
75          (B) any barriers during the application process;
76          (v) develop promotional material regarding CHIP and children's Medicaid eligibility,
77     including outreach through social media, video production, and other media platforms;
78          (vi) identify ways that the eligibility website for enrollment in CHIP and children's
79     Medicaid can be redesigned to increase accessibility and enhance the user experience;
80          (vii) identify outreach opportunities, including partnerships with community
81     organizations including:
82          (A) schools;
83          (B) small businesses;
84          (C) unemployment centers;
85          (D) parent-teacher associations; and
86          (E) youth athlete clubs and associations; and
87          (viii) develop messaging to increase awareness of coverage options that are available
88     through the department.
89          (3) (a) The program shall be funded solely with:

90          (i) money from the account; and
91          (ii) any federal matching funds that may be available through money from the account.
92          (b) The department may not delegate implementation of the program to a private entity.
93          (c) Notwithstanding Subsection (3)(b), the department may contract with a media
94     agency to conduct the activities described in Subsection (2)(b)(iv) and (vii).
95          (4) (a) There is created a restricted account within the General Fund known as the
96     "Children's Health Insurance Coverage Program Restricted Account."
97          (b) The restricted account consists of:
98          (i) money appropriated to the restricted account by the Legislature;
99          (ii) private donations; and
100          (iii) all income and interest derived from the deposit and investment of money in the
101     account.
102          (c) Subject to legislative appropriations, money in the restricted account may only be
103     used to fund activities related to the program.
104          Section 3. Section 63I-1-226 is amended to read:
105          63I-1-226. Repeal dates, Title 26.
106          (1) Subsection 26-1-7(1)(f), related to the Residential Child Care Licensing Advisory
107     Committee, is repealed July 1, 2024.
108          (2) Subsection 26-1-7(1)(h), related to the Primary Care Grant Committee, is repealed
109     July 1, 2025.
110          (3) Section 26-1-7.5, which creates the Utah Health Advisory Council, is repealed July
111     1, 2025.
112          (4) Section 26-1-40 is repealed July 1, 2022.
113          (5) Section 26-1-41 is repealed July 1, 2026.
114          (6) Section 26-7-10 is repealed July 1, 2025.
115          (7) Subsection 26-7-11(5), regarding reports to the Legislature, is repealed July 1,
116     2028.
117          (8) Section 26-7-14 is repealed December 31, 2027.
118          (9) Title 26, Chapter 9f, Utah Digital Health Service Commission Act, is repealed July
119     1, 2025.
120          (10) Subsection 26-10-6(5), which creates the Newborn Hearing Screening Committee,

121     is repealed July 1, 2026.
122          (11) Section 26-10-11 is repealed July 1, 2025.
123          (12) Section 26-10b-106, which creates the Primary Care Grant Committee, is repealed
124     July 1, 2025.
125          (13) Section 26-18-27 is repealed July 1, 2025.
126          [(13)] (14) Title 26, Chapter 18, Part 2, Drug Utilization Review Board, is repealed
127     July 1, 2027.
128          [(14) Subsection 26-18-417(3) relating to a report to the Health and Human services
129     Interim Committee is repealed July 1, 2020.]
130          (15) Subsection 26-18-418(2), the language that states "and the Behavioral Health
131     Crisis Response Commission created in Section 63C-18-202" is repealed July 1, 2023.
132          (16) Title 26, Chapter 18a, Kurt Oscarson Children's Organ Transplant Coordinating
133     Committee, is repealed July 1, 2021.
134          (17) Section 26-33a-117 is repealed on December 31, 2023.
135          (18) Title 26, Chapter 33a, Utah Health Data Authority Act, is repealed July 1, 2024.
136          (19) Title 26, Chapter 36b, Inpatient Hospital Assessment Act, is repealed July 1,
137     2024.
138          (20) Title 26, Chapter 36c, Medicaid Expansion Hospital Assessment Act, is repealed
139     July 1, 2024.
140          (21) Title 26, Chapter 36d, Hospital Provider Assessment Act, is repealed July 1, 2024.
141          (22) Section 26-39-201, which creates the Residential Child Care Licensing Advisory
142     Committee, is repealed July 1, 2024.
143          (23) Section 26-40-104, which creates the Utah Children's Health Insurance Program
144     Advisory Council, is repealed July 1, 2025.

149          (26) Title 26, Chapter 63, Nurse Home Visiting Pay-for-Success Program, is repealed
150     July 1, 2026.
151          (27) Title 26, Chapter 66, Early Childhood Utah Advisory Council, is repealed July 1,

153          Section 4. Appropriation.
154          The following sums of money are appropriated for the fiscal year beginning July 1,
155     2021, and ending June 30, 2022. These are additions to amounts previously appropriated for
156     fiscal year 2022.
157          Subsection 4(a). Restricted Fund and Account Transfers.
158          The Legislature authorizes the State Division of Finance to transfer the following
159     amounts between the following funds or accounts as indicated. Expenditures and outlays from
160     the funds to which the money is transferred must be authorized by an appropriation.
