9 General Description:
10 This bill requires a process for the Dixie State University Board of Trustees, in
11 consultation with the Utah Board of Higher Education, to select and recommend a name
12 for the institution and, if the boards choose, forward the name to the Legislature.
13 Highlighted Provisions:
14 This bill:
15 ▸ requires a process for the Dixie State University Board of Trustees (board of
16 trustees), in consultation with the Utah Board of Higher Education, to recommend a
17 name for the institution and, if the boards choose, forward the name to the
18 Legislature;
19 ▸ requires the board of trustees to create a Heritage Committee to preserve the
20 heritage, culture, and history of the region and the institution; and
21 ▸ makes technical changes.

36 Be it enacted by the Legislature of the state of Utah:
37 Section 1. Section 53B-2-111 is amended to read:
38 53B-2-111. Dixie State University -- Institutional name change.
39 (1) As used in this Section:
40 (a) "Board of trustees" means the board of trustees of Dixie State University.
41 (b) "Institution" means Dixie State University.

46 endowments, property, and claims of Dixie State College of Utah; and
47 [
48 obligations relating to outstanding bonds and notes.
49 (3) The board of trustees in consultation with the Utah Board of Higher Education
50 shall:
51 (a) create a committee to recommend a name for the institution; and
52 (b) ensure that the committee:
53 (i) represents students, university personnel, community members, and industry leaders
54 in the committee's membership;
55 (ii) provides opportunity for input from and collaboration with the public, including:
56 (A) residents of southwestern Utah;
57 (B) institutional partners; and
58 (C) university faculty, staff, students, and alumni;
59 (iii) reviews options for the institution's name; and
60 (iv) makes recommendations regarding the institution's name to the board of trustees.
61 (4) (a) The board of trustees shall:
62 (i) review the committee's recommendation described in Subsection (3)(b); and
63 (ii) choose whether to forward a name for the institution to the Utah Board of Higher
64 Education.
65 (b) Should the board of trustees choose to forward a name for the institution to the
66 Utah Board of Higher Education under Subsection (4)(a), the board of trustees shall ensure that
67 the name:
68 (i) reflects the institution's mission and significance to the surrounding region and
69 state; and
70 (ii) enables the institution to compete and be recognized nationally.
71 (c) Should the board of trustees recommend a name for the institution under
72 Subsection (4)(a), the Utah Board of Higher Education shall vote on whether to approve and
73 recommend the name to the Legislature.
74 (5) Should the Utah Board of Higher Education and the board of trustees recommend a
75 name for the institution to the Legislature through the process described in Subsections (3) and
76 (4), the Utah Board of Higher Education and the board of trustees shall recommend the name
77 for the institution to the Legislative Management Committee no later than November 1, 2021.
78 Section 2. Section 53B-16-502 is enacted to read:
79 53B-16-502. Heritage Committee.
80 Should the Dixie State University board of trustees and the Utah Board of Higher
81 Education forward a name to the Legislature that does not include the term "Dixie" under
82 Section 53B-2-111, the board of trustees shall establish a Heritage Committee to identify and
83 implement strategies to preserve the heritage, culture, and history of the region on the campus
84 of the institution, including the regional significance of the term "Dixie."
85 Section 3. Appropriation.
86 The following sums of money are appropriated for the fiscal year beginning July 1,
87 2021, and ending June 30, 2022. These are additions to amounts previously appropriated for
88 fiscal year 2022. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
89 Act, the Legislature appropriates the following sums of money from the funds or accounts
90 indicated for the use and support of the government of the state of Utah.

96 The Legislature intends that appropriations provided under this section be used for the
97 Heritage Committee described in Section 53B-16-502.
98 Section 4. Coordinating H.B. 278 with H.B. 279 -- Technical amendment.
99 If this H.B. 278 and H.B. 279, Higher Education for Incarcerated Youth, both pass and
100 become law, it is the intent of the Legislature that the Office of Legislative Research and
101 General Counsel renumber Section 53B-16-502 in this bill to Section 53B-30-401 in preparing
102 the Utah Code database for publication.
