8 General Description:
9 This bill creates the Clean Air for Schools Pilot Program.
10 Highlighted Provisions:

30 Be it enacted by the Legislature of the state of Utah:
31 Section 1. Section 53F-5-218 is enacted to read:
32 53F-5-218. Clean Air for Schools Pilot Program.
33 (1) As used in this section:
34 (a) "Eligible school" means a Title I school that is located within a nonattainment area
35 of the state.
36 (b) "Nonattainment area" means a part of the state where air quality is determined to
37 exceed the National Ambient Air Quality Standards, as defined in the Clean Air Act
38 Amendments of 1970, Pub. L. No. 91-604, Sec. 109, for fine particulate matter (PM 2.5).
39 (c) "Portable air filtration system" means a portable high-efficiency particulate air
40 purifier or cleaner designed to remove particles or contaminants from the air.
41 (d) "Title I school" means a school that receives funds under Title I of the Elementary
42 and Secondary Education Act of 1965, 20 U.S.C. Sec. 6301 et seq.
43 (e) "Program" means the Clean Air for Schools Pilot Program created in Subsection
44 (2).
45 (2) There is created the Clean Air for Schools Pilot Program to provide grants to LEAs
46 for purchase of portable air filtration systems to be installed in classrooms of eligible schools.
47 (3) The state board shall:
48 (a) solicit proposals from LEAs for a grant under this section; and
49 (b) award grants to LEAs under this section.
50 (4) To receive a grant under this section, an LEA shall submit a proposal to the state
51 board that:
52 (a) lists the eligible school or eligible schools that will receive a portable air filtration
53 system purchased by the LEA with the grant;
54 (b) the total number of students who attend the eligible school or eligible schools
55 described in Subsection (4)(a);
56 (c) the total number of portable air filtration systems needed for the eligible school or
57 eligible schools described in Subsection (4)(a); and
58 (d) the estimated cost of the LEA's proposal.
59 (5) An LEA that receives a grant under this section shall:
60 (a) use the grant to purchase portable air filtration systems for an eligible school or
61 eligible schools; and
62 (b) before October 1, 2024, report to the state board regarding the academic
63 performance of students in a classroom with a portable air filtration system purchased with the
64 grant.
65 (6) (a) Before December 1, 2024, the state board shall:
66 (i) prepare a report on the outcomes of the program that, at current standards of
67 scientific rigor:
68 (A) analyzes the academic performance data collected under Subsection (5) and the air
69 quality monitoring data for the nonattainment areas in which the eligible schools served under
70 the program are located; and
71 (B) describes the impact of the program on student academic performance; and
72 (ii) provide the report to Education Interim Committee and the Natural Resources,
73 Agriculture, and Environment Interim Committee.
74 (b) The state board may contract with another state agency, private entity, or research
75 institution to assist the state board with the report.
76 Section 2. Section 63I-1-253 is amended to read:
77 63I-1-253. Repeal dates, Titles 53 through 53G.
78 (1) Section 53-2a-105, which creates the Emergency Management Administration
79 Council, is repealed July 1, 2021.
80 (2) Sections 53-2a-1103 and 53-2a-1104, which create the Search and Rescue Advisory
81 Board, are repealed July 1, 2022.
82 (3) Section 53-5-703, which creates the Concealed Firearm Review Board, is repealed
83 July 1, 2023.
84 (4) Subsection 53-6-203(1)(b)(ii), regarding being 19 years old at certification, is
85 repealed July 1, 2027.
86 (5) Subsection 53-13-104(6)(a), regarding being 19 years old at certification, is
87 repealed July 1, 2027.
88 (6) Section 53B-6-105.5, which creates the Technology Initiative Advisory Board, is
89 repealed July 1, 2024.
90 (7) Title 53B, Chapter 17, Part 11, USTAR Researchers, is repealed July 1, 2028.
91 (8) Section 53B-17-1203, which creates the SafeUT and School Safety Commission, is
92 repealed January 1, 2025.
93 (9) Section 53B-18-1501 is repealed July 1, 2021.
94 (10) Title 53B, Chapter 18, Part 16, USTAR Researchers, is repealed July 1, 2028.
95 (11) Title 53B, Chapter 24, Part 4, Rural Residency Training Program, is repealed July
96 1, 2025.
97 (12) Subsection 53C-3-203(4)(b)(vii), which provides for the distribution of money
98 from the Land Exchange Distribution Account to the Geological Survey for test wells and other
99 hydrologic studies in the West Desert, is repealed July 1, 2030.
100 (13) Section 53E-3-515 is repealed January 1, 2023.
101 (14) In relation to a standards review committee, on January 1, 2023:
102 (a) in Subsection 53E-4-202(8), the language "by a standards review committee and the
103 recommendations of a standards review committee established under Section 53E-4-203" is
104 repealed; and
105 (b) Section 53E-4-203 is repealed.
106 (15) Subsections 53E-3-503(5) and (6), which create coordinating councils for youth in
107 custody, are repealed July 1, 2027.
108 (16) Section 53E-4-402, which creates the State Instructional Materials Commission, is
109 repealed July 1, 2022.
110 (17) Title 53E, Chapter 6, Part 5, Utah Professional Practices Advisory Commission, is
111 repealed July 1, 2023.
112 (18) Subsection 53E-8-204(4), which creates the advisory council for the Utah Schools
113 for the Deaf and the Blind, is repealed July 1, 2021.

122 (24) Section 53F-5-218, in relation to the Clean Air for Schools Pilot Program, is

124 (25) Subsection 53F-9-203(7), which creates the Charter School Revolving Account
125 Committee, is repealed July 1, 2024.
126 (26) Section 53F-9-501 is repealed January 1, 2023.
127 (27) Subsections 53G-4-608(2)(b) and (4)(b), related to the Utah Seismic Safety
128 Commission, are repealed January 1, 2025.
129 (28) Subsection 53G-8-211(5), regarding referrals of a minor to court for a class C
130 misdemeanor, is repealed July 1, 2022.
131 Section 3. Appropriation.
132 The following sums of money are appropriated for the fiscal year beginning July 1,
133 2021, and ending June 30, 2022. These are additions to amounts previously appropriated for
134 fiscal year 2022. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
135 Act, the Legislature appropriates the following sums of money from the funds or accounts
136 indicated for the use and support of the government of the state of Utah.
