8 General Description:
9 This bill creates the Utah Immigration Assistance Center.
10 Highlighted Provisions:
11 This bill:
12 ▸ defines terms;
13 ▸ creates the Utah Immigration Assistance Center (center) in the Governor's Office of

15 ▸ establishes the responsibilities of the center; and

28 Be it enacted by the Legislature of the state of Utah:
29 Section 1. Section 63N-16-101 is enacted to read:

32 63N-16-101. Title.
33 This chapter is known as the "Utah Immigration Assistance Center."
34 Section 2. Section 63N-16-102 is enacted to read:
35 63N-16-102. Definitions.
36 As used in this chapter:
37 (1) "Center" means the Utah Immigration Assistance Center.
38 (2) "Foreign labor" means one or more individuals from a nation other than the United
39 States who are eligible to participate in visa programs established by the federal government to
40 work in the state.
41 (3) "Foreign labor programs" means programs established by the United States
42 Department of Labor to bring eligible foreign individuals to the United States for employment
43 opportunities.
44 Section 3. Section 63N-16-103 is enacted to read:
45 63N-16-103. Creation of the Utah Immigration Assistance Center --
46 Responsibilities of the Utah Immigration Assistance Center.
47 (1) There is created within the Governor's Office of Economic Development the Utah
48 Immigration Assistance Center.
49 (2) The center shall:
50 (a) coordinate and provide technical support for businesses in the state that intend to
51 utilize federal foreign labor programs;
52 (b) provide outreach and information to businesses that could benefit from foreign
53 labor programs;
54 (c) coordinate with state and federal government partners to facilitate the successful
55 use of foreign labor programs on behalf of businesses in the state; and
56 (d) coordinate with other entities engaged in international efforts.
57 (3) The center may not encourage a business to bypass state residents for the business's
58 workforce needs.
59 (4) The center may, in accordance with Title 63G, Chapter 3, Utah Administrative
60 Rulemaking Act, make rules to carry out the center's responsibilities under this chapter.
61 Section 4. Section 63N-16-104 is enacted to read:
62 63N-16-104. Annual report.
63 The office shall include in the annual written report described in Section 63N-1-301, a
64 report of the center's operations, including:
65 (1) the number of businesses that received assistance in utilizing foreign labor
66 programs;
67 (2) the number of individuals who were able to work in the state as a result of foreign
68 labor programs; and
69 (3) recommendations regarding changes that would improve the center.
