8 General Description:
9 This bill creates the Utah Main Street Program (program) within the Governor's Office
10 of Economic Development (GOED).
11 Highlighted Provisions:
12 This bill:

28 Be it enacted by the Legislature of the state of Utah:
29 Section 1. Section 63N-3-601 is enacted to read:

31 63N-3-601. Definitions.
32 As used in this part:
33 (1) "Advisory committee" means the Utah Main Street Advisory Committee created in
34 Section 63N-3-603.
35 (2) "Center" means the National Main Street Center.
36 (3) "Program" means the Utah Main Street Program created in Section 63N-3-602.
37 Section 2. Section 63N-3-602 is enacted to read:
38 63N-3-602. Utah Main Street Program.
39 (1) The Utah Main Street Program is created within the office to provide resources for
40 the revitalization of downtown or commercial district areas of municipalities in the state.
41 (2) To implement the program, the office may:
42 (a) become a member of the National Main Street Center and partner with the center to
43 become the statewide coordinating program for participating municipalities in the state;
44 (b) establish criteria for the designation of one or more local main street programs
45 administered by a county or municipality in the state;
46 (c) consider the recommendations of the advisory committee in designating and
47 implementing local main street programs;
48 (d) provide training and technical assistance to local governments, businesses, property
49 owners, or other organizations that participate in designated local main street programs;
50 (e) subject to appropriations from the Legislature or other funding, provide financial
51 assistance to designated local main street programs; and
52 (f) under the direction of the executive director, appoint full-time staff.
53 (3) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
54 office may make rules establishing the eligibility and reporting criteria for a downtown area to
55 receive a local main street program designation, including requirements for:
56 (a) local government support of the local main street program; and
57 (b) collecting data to measure economic development impact.
58 (4) The office shall include in the annual written report described in Section
59 63N-1-301, a report of the program's operations and details of which municipalities have
60 received:
61 (a) a local main street program designation; and
62 (b) financial support from the program.
63 Section 3. Section 63N-3-603 is enacted to read:
64 63N-3-603. Main Street Program Advisory Committee -- Membership -- Duties.
65 (1) There is created in the office the Main Street Program Advisory Committee.
66 (2) The advisory committee is composed of the following members appointed by the
67 executive director:
68 (a) a representative of the office who provides administrative oversight of the program;
69 (b) a representative of the office involved in tourism development;
70 (c) a representative of the Department of Heritage and Arts;
71 (d) a representative of the State Historic Preservation Office;
72 (e) a representative of the Utah Department of Transportation;
73 (f) a representative of the Housing and Community Development Division;
74 (g) a representative from a local association of governments;
75 (h) a representative from the private sector involved in a local main street program;
76 (i) a representative of a local main street program; and
77 (j) three representatives from various entities that have an interest or expertise in
78 assisting local main street programs.
79 (3) The advisory committee shall advise and make recommendations to the office
80 regarding:
81 (a) the eligibility of applicants for designation as a local main street program;
82 (b) financial assistance requests from designated local main street programs; and
83 (c) improving the effectiveness of the program.
84 (4) (a) Except as provided under Subsection (4)(b), each member of the advisory
85 committee appointed under Subsections (2)(g) through (j) shall be appointed for a four-year
86 term.
87 (b) The executive director, at the time of appointment or reappointment, may adjust the
88 length of terms to ensure that the terms of approximately half of the members of the advisory
89 committee appointed under Subsections (2)(g) through (j) end every two years.
90 (5) The representative of the office appointed under Subsection (2)(a) shall serve as
91 chair of the advisory committee.
92 (6) When a vacancy occurs in the membership for any reason, the executive director
93 shall appoint a replacement member.
94 (7) A majority of the advisory committee constitutes a quorum for the purpose of
95 conducting advisory committee business and the action of a majority of a quorum constitutes
96 the action of the advisory committee.
97 (8) A member may not receive compensation or benefits for the member's service, but
98 a member may receive per diem and travel expenses in accordance with:
99 (a) Section 63A-3-106;
100 (b) Section 63A-3-107; and
101 (c) rules made by the Division of Finance pursuant to Sections 63A-3-106 and
102 63A-3-107.
