7     LONG TITLE
8     General Description:
9          This bill creates the offense of delivered package theft.
10     Highlighted Provisions:
11          This bill:
12          ▸     creates the offense of delivered package theft; and
13          ▸     imposes penalties including mandatory jail time and a minimum fine.

22     Be it enacted by the Legislature of the state of Utah:
23          Section 1. Section 76-6-1003.1 is enacted to read:
24          76-6-1003.1. Delivered package theft.
25          (1) As used in this section:
26          (a) "Dwelling" means the same as that term is defined in Section 76-6-201.
27          (b) (i) "Delivered package" means a package, parcel, envelope, or other item and its
28     contents that has been delivered to a dwelling by a delivery service, delivery person, common

29     mail carrier, or the United States Postal Service.
30          (ii) "Delivered package" includes mail as defined in Section 76-6-1001.
31          (2) An individual commits the crime of delivered package theft if the individual
32     knowingly, and with the intent to deprive another:
33          (a) takes, destroys, hides, or embezzles a delivered package from the porch, steps, or the
34     vicinity of any entrance or exit of a dwelling; or
35          (b) obtains by fraud or deception a delivered package from the porch, steps, or the
36     vicinity of any entrance or exit of a dwelling.
37          (3) (a) Delivered package theft is a third degree felony.
38          (b) As part of a sentence for a conviction under this section, the court shall:
39          (i) impose a jail sentence of not less than 10 days; and
40          (ii) impose a fine of not less than $3,000.
