8 General Description:
9 This bill provides that a local education agency is not required to enforce a requirement
10 in a public health order for individuals to wear a face mask on school grounds.

24 Be it enacted by the Legislature of the state of Utah:
25 Section 1. Section 53G-9-210 is enacted to read:
26 53G-9-210. Mask requirement during COVID-19 emergency.
27 (1) As used in this section:
28 (a) "COVID-19 emergency" means the same as that term is defined in 53G-6-502.
29 (b) "Face mask" means the same as that term is defined in a public health order that
30 requires individuals to wear a face mask on school grounds.
31 (c) "Public health emergency" means the same as that term is defined in Section
32 53-2c-102.
33 (d) "Public health order" means an order issued in response to a public health
34 emergency that is:
35 (i) an executive order that the governor issues:
36 (A) declaring a state of emergency under Section 53-2a-206; or
37 (B) under a state of emergency declared under Section 53-2a-206;
38 (ii) an order that the Department of Health issues; or
39 (iii) an order that a local health department issues.
40 (2) Notwithstanding anything to the contrary in Utah law, an LEA is not required to
41 enforce a requirement in a public health order issued in response to the COVID-19 emergency
42 for individuals to wear a face mask on school grounds.
