9     General Description:
10          This bill creates the Statewide Credentials and Certification Program.
11     Highlighted Provisions:
12          This bill:
13          ▸     defines terms;
14          ▸     creates the Statewide Credentials and Certification Program (the program), which
15     consists of an online platform and a grant program designed to link students, job
16     seekers, employers, and education agencies to education and employment
17     opportunities;
18          ▸     requires Snow College to:
19               •     administer the program;
20               •     collaborate with state agencies, employers, and education agencies to establish
21     content based on state employment and education needs; and
22               •     report annually to the Legislature metrics about the program;
23          ▸     establishes the responsibilities of the online platform administrator;
24          ▸     creates the Statewide Credentials and Certification Program Restricted Account and
25     provides that appropriations from the account are nonlapsing; and
26          ▸     makes technical and conforming changes.

45     Be it enacted by the Legislature of the state of Utah:
46          Section 1. Section 53B-26-401 is enacted to read:
47     
Part 4. Statewide Credentials and Certification Program

48          53B-26-401. Definitions.
49          As used in this part:
50          (1) "Account" means the Statewide Credentials and Certification Program Restricted
51     Account created in Section 53B-26-405.
52          (2) "Certification" means a method for an individual who has completed a course of
53     study to earn or renew a microcredential through demonstration of mastery and application of
54     the knowledge or skill set.
55          (3) "Certification entity" means a person that:
56          (a) develops a microcredential;
57          (b) approves a microcredential; or
58          (c) reviews materials submitted for certification.

59          (4) "Course of study" means:
60          (a) a formal education course;
61          (b) a training course; or
62          (c) an informal, experiential training.
63          (5) "Demonstration of mastery and application" means submission of evidence for
64     evaluation.
65          (6) "Digital rubric" means a standardized scoring guide.
66          (7) "Microcredential" means a certification that an individual has demonstrated
67     mastery and application of a particular knowledge or skill set.
68          (8) "Program" means the Statewide Credentials and Certification Program created in
69     Section 53B-26-402.
70          (9) "Reviewer" means an individual who:
71          (a) is approved by:
72          (i) the entity offering the microcredential; and
73          (ii) if the individual is reviewing a demonstration of mastery and application for
74     college academic credit, Snow College; and
75          (b) reviews the demonstration of mastery and application using a digital rubric.
76          Section 2. Section 53B-26-402 is enacted to read:
77          53B-26-402. Statewide Credentials and Certification Program.
78          (1) There is created the Statewide Credentials and Certification Program, which shall
79     consist of:
80          (a) an online platform to connect students, job seekers, employers, education agencies,
81     and certification entities; and
82          (b) a grant program to allow:
83          (i) a certification entity to make some microcredentials available to earn or renew on
84     the online platform for free; and
85          (ii) an individual to receive funds to pay for microcredentials on the online platform.
86          (2) (a) Snow College shall administer the program.
87          (b) Snow College's responsibilities for the program include:
88          (i) soliciting and selecting an online platform administrator and managing a contract to
89     develop and maintain the online platform;

90          (ii) partnering with state agencies to provide marketing of the program, including
91     targeted outreach to the areas with the highest needs;
92          (iii) with the assistance of the online platform administrator, establishing content for
93     the online platform by:
94          (A) collaborating with state agencies, employers, and education agencies on the
95     economic and educational needs of the state; and
96          (B) building partnerships with businesses, nonprofit organizations, and education
97     agencies to develop and offer microcredentials aimed at addressing the economic and
98     educational needs of the state;
99          (iv) facilitating academic transferability for microcredentials earned or renewed on the
100     online platform;
101          (v) monitoring the usage and demands of the program;
102          (vi) depositing fees forwarded in accordance with Subsection 53B-26-403(3)(b) or
103     (3)(c) into the account; and
104          (vii) administering the grant program.
105          (3) Snow College has the right to approve or deny the content on the online platform.
106          (4) (a) On or before October 1, Snow College shall report electronically to:
107          (i) the Economic Development and Workforce Services Interim Committee;
108          (ii) the Education Interim Committee; and
109          (iii) the Higher Education Appropriations Subcommittee.
110          (b) The report described in Subsection (4)(a) shall include:
111          (i) a summary of the usage of the program, including:
112          (A) the number of users on the online platform by type;
113          (B) the pattern of usage of the online platform, including which services are most used;
114          (C) aggregated demographic and geographic location information of the users on the
115     online platform;
116          (D) the number of grants awarded and the average amount of a grant award;
117          (E) the number of microcredentials and college academic credits earned;
118          (F) the number of microcredentials earned that were offered for free; and
119          (G) aggregated information about educational advancement or career opportunities
120     from usage of the online platform;

121          (ii) a summary of:
122          (A) the costs of the program; and
123          (B) the revenue generated by the program; and
124          (iii) any opportunities or needs that Snow College identifies for the program and
125     recommendations for addressing the identified opportunities or needs.
126          (c) The report described in Subsection (4)(a) shall include the information described in
127     Subsection (4)(b) for the previous year and for the life of the program.
128          (5) Snow College may adopt policies governing the administration of the program.
129          Section 3. Section 53B-26-403 is enacted to read:
130          53B-26-403. Online platform.
131          (1) The online platform shall serve as a connection point between students, job seekers,
132     employers, education agencies, and certification entities, including opportunities for:
133          (a) a student or a job seeker to:
134          (i) increase the job seeker's education;
135          (ii) earn or renew microcredentials;
136          (iii) learn about grants to assist with the cost of earning or renewing a microcredential;
137          (iv) identify potential employment opportunities; and
138          (v) advertise the job seeker's credentials;
139          (b) an employer to develop a workforce;
140          (c) an education agency to offer courses of study; and
141          (d) a certification entity to:
142          (i) develop and offer microcredentials; and
143          (ii) partner with employers and recruit persons that can offer certification.
144          (2) The online platform shall include:
145          (a) an interface between the online platform administrator and a certification entity to:
146          (i) facilitate the development of and approval of microcredentials that will assist
147     students and job seekers in advancing students' and job seekers' career or educational
148     opportunities; and
149          (ii) create and share microcredentials;
150          (b) a catalog of available microcredentials, including information about:
151          (i) the required demonstration of mastery and application to earn or renew the

152     microcredential; and
153          (ii) the digital rubric by which a reviewer will evaluate the demonstration of mastery
154     and application;
155          (c) processes to:
156          (i) upload and store demonstrations of mastery and application;
157          (ii) route demonstrations of mastery and application to reviewers;
158          (iii) route a completed digital rubric to the applicable certification entity; and
159          (iv) award microcredentials;
160          (d) online support to users for submitting demonstrations of mastery and application,
161     including the ability to submit multiple demonstrations of mastery and application for one
162     microcredential;
163          (e) a mechanism to provide feedback to individuals seeking certification to earn or
164     renew a microcredential;
165          (f) a means for a user to share receipt of a microcredential with an employer or an
166     education agency;
167          (g) employment development opportunities, including solicitation of certification
168     entities;
169          (h) an option for an education agency or an employer to pre-purchase microcredentials
170     for distribution to particular individuals;
171          (i) education opportunity announcements;
172          (j) data visualization tools for the platform administrator to assist Snow College with
173     the reporting requirements described in Section 53B-26-402; and
174          (k) information about the grant program.
175          (3) (a) The online platform shall charge a fee for the following services on the online
176     platform:
177          (i) the application to receive a microcredential; and
178          (ii) the use of the online platform by an employer for the purpose of developing or
179     offering a microcredential or recruiting employees.
180          (b) (i) The fee for earning or renewing a microcredential:
181          (A) shall be set by the entity offering the microcredential; and
182          (B) may not exceed $50 unless the microcredential includes college academic credit.

183          (ii) Subject to Subsections (3)(b)(iii) and (iv), the online platform administrator shall
184     forward any payments, including grant funds, for earning or renewing a microcredential to the
185     certification entity offering the microcredential.
186          (iii) The online platform administrator shall remit to Snow College, an amount
187     established by the contract between Snow College and the administrator, that is at least $5 per
188     paid microcredential earned on the online platform.
189          (iv) The online platform administrator shall forward half of the payment, after setting
190     aside the amount described in Subsection (3)(b)(iii), at the time the payment is received and the
191     remainder after the certification is complete.
192          (c) (i) The fee for usage by an employer is based on the size of the organization.
193          (ii) The online platform administrator shall use a portion of the usage fee described in
194     Subsection (3)(c)(i) to compensate reviewers as provided by the certification entity offering the
195     microcredential and the reviewer.
196          (iii) The online platform administrator shall forward the balance of usage fees to Snow
197     College.
198          (4) The online platform administrator shall:
199          (a) provide secure storage of:
200          (i) a user's confidential information;
201          (ii) a user's uploaded evidence for demonstration of mastery and application to earn or
202     renew a microcredential; and
203          (iii) the digital rubric and a reviewer's completed digital rubric after evaluation of a
204     user's demonstration of mastery and application of knowledge;
205          (b) permit a user to:
206          (i) upload evidence for demonstration of mastery and application to earn or renew a
207     microcredential;
208          (ii) authorize the sharing of confidential information with designated users on the
209     online platform; and
210          (iii) retain ownership, including the right to access and share, of the user's personal
211     microcredential certifications outside of the online platform;
212          (c) ensure proper routing of financial payments;
213          (d) provide to Snow College:

214          (i) a monthly accounting of financial payments received and paid; and
215          (ii) a summary of user information needed for Snow College to make the report
216     described in Section 53B-26-402; and
217          (e) assist Snow College with outreach and marketing of the online platform.
218          Section 4. Section 53B-26-404 is enacted to read:
219          53B-26-404. Grant program.
220          (1) Snow College shall provide grants to pay for the cost of earning or renewing a
221     microcredential.
222          (2) Snow College may award grant funds to:
223          (a) a certification entity proposing to make a microcredential available to earn or renew
224     on the online platform for free; or
225          (b) an individual to pay the costs of earning or renewing a microcredential.
226          (3) To be eligible to receive a grant under this part:
227          (a) a certification entity shall demonstrate that the proposed microcredential will assist:
228          (i) employers in the state in attracting high quality applicants to open positions; or
229          (ii) students or job seekers in the state in improving the student's or the job seeker's
230     career or educational advancement; or
231          (b) an individual shall demonstrate:
232          (i) residency in the state;
233          (ii) financial need; and
234          (iii) the benefit that receipt of the microcredential will have to the individual's career or
235     educational advancement.
236          (4) Snow College shall establish:
237          (a) an application process by which a certification entity or an individual may apply for
238     a grant under this section, which application shall include:
239          (i) a description of the microcredential proposed to be offered or earned;
240          (ii) cost information and any other sources of funding available to the applicant; and
241          (iii) any other information about the microcredential that Snow College requests; and
242          (b) a formula to divide available grant funds among certification entities and
243     individuals, prioritize grant applications, and award grant funds.
244          Section 5. Section 53B-26-405 is enacted to read:

245          53B-26-405. Statewide Credentials and Certification Program Restricted Account.
246          (1) There is created in the General Fund a restricted account known as the Statewide
247     Credentials and Certification Program Restricted Account.
248          (2) (a) The account is funded from:
249          (i) money appropriated by the Legislature;
250          (ii) usage fees described in Subsection 53B-26-403(3)(c);
251          (iii) the portion of the microcredential fee described in Subsection
252     53B-26-403(3)(b)(iii); and
253          (iv) interest earned on money in the account.
254          (b) In accordance with Section 63J-1-602.1, appropriations made from the account are
255     nonlapsing.
256          (3) (a) The account shall earn interest.
257          (b) Interest earned on the money in the account shall be deposited into the account.
258          (4) Subject to appropriation, Snow College may use money deposited into the account
259     to pay:
260          (a) Snow College's costs for administering the program;
261          (b) the online platform administrator's fees as provided by contract; and
262          (c) grants awarded in accordance with Section 53B-26-404.
263          Section 6. Section 63I-1-263 is amended to read:
264          63I-1-263. Repeal dates, Titles 63A to 63N.
265          (1) In relation to the Utah Transparency Advisory Board, on January 1, 2025:
266          (a) Subsection 63A-1-201(1) is repealed;
267          (b) Subsection 63A-1-202(2)(c), the language "using criteria established by the board"
268     is repealed;
269          (c) Section 63A-1-203 is repealed;
270          (d) Subsections 63A-1-204(1) and (2), the language "After consultation with the board,
271     and" is repealed; and
272          (e) Subsection 63A-1-204(1)(b), the language "using the standards provided in
273     Subsection 63A-1-203(3)(c)" is repealed.
274          (2) Subsection 63A-5b-405(5), relating to prioritizing and allocating capital
275     improvement funding, is repealed July 1, 2024.

276          (3) Section 63A-5b-1003, State Facility Energy Efficiency Fund, is repealed July 1,
277     2023.
278          (4) Sections 63A-9-301 and 63A-9-302, related to the Motor Vehicle Review
279     Committee, are repealed July 1, 2023.
280          (5) Title 63C, Chapter 4a, Constitutional and Federalism Defense Act, is repealed July
281     1, 2028.
282          (6) Title 63C, Chapter 6, Utah Seismic Safety Commission, is repealed January 1,
283     2025.
284          (7) Title 63C, Chapter 12, Snake Valley Aquifer Advisory Council, is repealed July 1,
285     2024.
286          (8) Title 63C, Chapter 17, Point of the Mountain Development Commission Act, is
287     repealed July 1, 2021.
288          (9) Title 63C, Chapter 18, Behavioral Health Crisis Response Commission, is repealed
289     July 1, 2023.
290          (10) Title 63C, Chapter 21, Outdoor Adventure Commission, is repealed July 1, 2025.
291          (11) Title 63F, Chapter 2, Data Security Management Council, is repealed July 1,
292     2025.
293          (12) Section 63G-6a-805, which creates the Purchasing from Persons with Disabilities
294     Advisory Board, is repealed July 1, 2026.
295          (13) Title 63G, Chapter 21, Agreements to Provide State Services, is repealed July 1,
296     2025.
297          (14) Title 63H, Chapter 4, Heber Valley Historic Railroad Authority, is repealed July 1,
298     2024.
299          (15) Title 63H, Chapter 8, Utah Housing Corporation Act, is repealed July 1, 2026.
300          (16) Subsection 63J-1-602.1(14), Nurse Home Visiting Restricted Account is repealed
301     July 1, 2026.
302          (17) (a) Subsection 63J-1-602.1[(58)] (59), relating to the Utah Statewide Radio
303     System Restricted Account, is repealed July 1, 2022.
304          (b) When repealing Subsection 63J-1-602.1[(58)] (59), the Office of Legislative
305     Research and General Counsel shall, in addition to the office's authority under Subsection
306     36-12-12(3), make necessary changes to subsection numbering and cross references.

307          (18) Subsection 63J-1-602.2(4), referring to dedicated credits to the Utah Marriage
308     Commission, is repealed July 1, 2023.
309          (19) Subsection 63J-1-602.2(5), referring to the Trip Reduction Program, is repealed
310     July 1, 2022.
311          (20) Subsection 63J-1-602.2(25), related to the Utah Seismic Safety Commission, is
312     repealed January 1, 2025.
313          (21) Title 63J, Chapter 4, Part 5, Resource Development Coordinating Committee, is
314     repealed July 1, 2027.
315          (22) Subsection 63J-4-608(3), which creates the Federal Land Application Advisory
316     Committee, is repealed on July 1, 2021.
317          (23) In relation to the Utah Substance Use and Mental Health Advisory Council, on
318     January 1, 2023:
319          (a) Sections 63M-7-301, 63M-7-302, 63M-7-303, 63M-7-304, and 63M-7-306 are
320     repealed;
321          (b) Section 63M-7-305, the language that states "council" is replaced with
322     "commission";
323          (c) Subsection 63M-7-305(1) is repealed and replaced with:
324          "(1) "Commission" means the Commission on Criminal and Juvenile Justice."; and
325          (d) Subsection 63M-7-305(2) is repealed and replaced with:
326          "(2) The commission shall:
327          (a) provide ongoing oversight of the implementation, functions, and evaluation of the
328     Drug-Related Offenses Reform Act; and

331          (24) The Crime Victim Reparations and Assistance Board, created in Section
332     63M-7-504, is repealed July 1, 2027.
333          (25) Title 63M, Chapter 7, Part 6, Utah Council on Victims of Crime, is repealed July
334     1, 2022.
335          (26) Title 63M, Chapter 11, Utah Commission on Aging, is repealed July 1, 2021.
336          (27) Subsection 63N-1-301(4)(c), related to the Talent Ready Utah Board, is repealed
337     January 1, 2023.

338          (28) Title 63N, Chapter 1, Part 5, Governor's Economic Development Coordinating
339     Council, is repealed July 1, 2024.

354     July 1, 2023.
355          (34) Title 63N, Chapter 7, Part 1, Board of Tourism Development, is repealed July 1,
