8 General Description:
9 This bill supplements or reduces appropriations otherwise provided for the support and
10 operation of state government for the fiscal year beginning July 1, 2021 and ending June 30, 2022
11 and for the fiscal year beginning July 1, 2022 and ending June 30, 2023.
12 Highlighted Provisions:
13 This bill:
14 ▸ provides budget increases and decreases for the use and support of certain state agencies;
15 ▸ provides budget increases and decreases for the use and support of certain public
16 education programs;
17 ▸ provides budget increases and decreases for the use and support of certain institutions of
18 higher education;
19 ▸ provides funds for the bills with fiscal impact passed in the 2022 General Session;
20 ▸ provides budget increases and decreases for other purposes as described;
21 ▸ provides a mathematical formula for the annual appropriations limit; and,
22 ▸ provides intent language.
23 Money Appropriated in this Bill:
24 This bill appropriates $320,777,600 in operating and capital budgets for fiscal year 2022,
25 including:

27 ▸ $14,876,300 from the Education Fund; and
28 ▸ $309,718,600 from various sources as detailed in this bill.
29 This bill appropriates ($2,043,500) in expendable funds and accounts for fiscal year 2022.

62 Be it enacted by the Legislature of the state of Utah:
63 Section 1. FY 2022 Appropriations. The following sums of money are appropriated for the
64 fiscal year beginning July 1, 2021 and ending June 30, 2022. These are additions to amounts
65 otherwise appropriated for fiscal year 2022.
66 Subsection 1(a). Operating and Capital Budgets. Under the terms and conditions of
67 Title 63J, Chapter 1, Budgetary Procedures Act, the Legislature appropriates the following sums of
68 money from the funds or accounts indicated for the use and support of the government of the state of

252 Notwithstanding the intent language in Business, Economic
253 Development, and Labor Base Budget (Senate Bill 4 Substitute
254 1, 2022 General Session) Item 10, the Legislature intends that,
255 under Section 63J-1-603 of the Utah Code, appropriations
256 provided to the Governor's Office of Economic Opportunity -
257 Pass Through in Laws of Utah 2021, shall not lapse at the close
258 of Fiscal Year 2022. The use of any non-lapsing funds is
259 limited to contractual obligations and support, $50,000,000.
260 The Legislature intends that the Governor's Office of
261 Economic Opportunity reduce American Rescue Plan Act
262 funding allocated for Redevelopment Matching Grants funded
263 in Appropriations Adjustments (Senate Bill 1001, 2021 First
264 Special Session) Item 53 by $5,000,000.
265 Notwithstanding the intent language in Appropriations
266 Adjustment (Senate Bill 1001, 2022 First Special Session) Item
267 53 regarding $35 million provided by that item for
268 Redevelopment Matching Grants, the Legislature intends that
269 Go Utah use the remaining $30 million provided by that item
270 for a matching grant program to assist cities, counties, and
271 special districts (applicants) in building stronger communities
272 through investment in housing and neighborhoods.
273 The matching program shall create incentives for applicants
274 to redevelop and rezone current commercial, retail, or
275 industrial vacant land to a zone that will allow higher density
276 housing as a permitted use and the program shall create a grant
277 for water conservation districts or special service districts to
278 conserve or develop water assets. An applicant may qualify for
279 a matching grant if:
280 (1) after January 1, 2021, the applicant rezones vacant,
281 undeveloped land that is currently zoned commercial,
282 industrial, or retail to a zone that allows for development of
283 affordable residential housing (attached or detached) as a
284 permitted use at a minimum density of eight units per acre, and
285 the applicant can demonstrate that the applicant has approved a
286 development application with a corresponding affordable
287 residential component; or,
288 (2) after January 1, 2021, the applicant approves a
289 redevelopment application that allows for the creation of new
290 or additional affordable housing units (attached or detached) at
291 a density of at least eight units to the acre.
292 By applying to Go Utah, a applicant that meets either of the
293 foregoing qualifications may qualify for a grant of up to $2.5
294 million to match a like amount of applicant funds that the
295 applicant demonstrates it has spent or will spend on the
296 qualifying project. An applicant may receive an additional
297 $1.5 million for any qualifying project that includes at least
298 1,000 housing units or is at least 40 units per acre. An applicant
299 may qualify upon application to Go Utah for a grant to begin or
300 complete a project that conserves or develops water assets. The
301 grant amounts available for water assets under this program do
302 not require a match and shall not exceed 35% of total grants
303 made.
304 An applicant may utilize the grant money to help increase
305 supply of affordable and high quality living units, provided that
306 the grant money is spent or encumbered within six months and
307 in accordance with the American Rescue Plan Act.
308 An applicant may not apply for a grant until the time
309 allowed for the filing of a land use referendum has expired or
310 until the applicant can demonstrate that the qualifying project
311 is not the subject of any land use referendum or initiative.
312 In awarding a matching grant under this item, Go Utah
313 shall make rules in accordance with Title 63G, Chapter 3, Utah
314 Administrative Rulemaking Act, establishing the eligibility and
315 reporting criteria for an applicant to receive a matching grant,
316 including: (1) the form and process of applying for a matching
317 grant; (2) the method and formula for determining grant
318 amounts; and (3) the reporting requirements of grant recipients.
319 Go Utah shall provide a report describing the distribution
320 and uses of the grant money to the Governor's Office of
321 Planning and Budget and to the Office of the Legislative Fiscal
322 Analyst. Additionally, Go Utah shall include information
323 describing the distribution and use of the grant money in the
324 office's annual report currently described in Section
325 63N-1a-306.

1721 Redevelopment Matching Grants, the Legislature intends that
1722 Go Utah use the remaining $30 million provided by that item
1723 for a matching grant program to assist cities, counties, and
1724 special districts (applicants) in building stronger communities
1725 through investment in housing and neighborhoods.
1726 The matching program shall create incentives for applicants
1727 to redevelop and rezone current commercial, retail, or
1728 industrial vacant land to a zone that will allow higher density
1729 housing as a permitted use and the program shall create a grant
1730 for water conservation districts or special service districts to
1731 conserve or develop water assets. An applicant may qualify for
1732 a matching grant if:
1733 (1) after January 1, 2021, the applicant rezones vacant,
1734 undeveloped land that is currently zoned commercial,
1735 industrial, or retail to a zone that allows for development of
1736 affordable residential housing (attached or detached) as a
1737 permitted use at a minimum density of eight units per acre, and
1738 the applicant can demonstrate that the applicant has approved a
1739 development application with a corresponding affordable
1740 residential component; or,
1741 (2) after January 1, 2021, the applicant approves a
1742 redevelopment application that allows for the creation of new
1743 or additional affordable housing units (attached or detached) at
1744 a density of at least eight units to the acre.
1745 By applying to Go Utah, a applicant that meets either of the
1746 foregoing qualifications may qualify for a grant of up to $2.5
1747 million to match a like amount of applicant funds that the
1748 applicant demonstrates it has spent or will spend on the
1749 qualifying project. An applicant may receive an additional
1750 $1.5 million for any qualifying project that includes at least
1751 1,000 housing units or is at least 40 units per acre. An applicant
1752 may qualify upon application to Go Utah for a grant to begin or
1753 complete a project that conserves or develops water assets. The
1754 grant amounts available for water assets under this program do
1755 not require a match and shall not exceed 35% of total grants
1756 made.
1757 An applicant may utilize the grant money to help increase
1758 supply of affordable and high quality living units, provided that
1759 the grant money is spent or encumbered within six months and
1760 in accordance with the American Rescue Plan Act.
1761 An applicant may not apply for a grant until the time
1762 allowed for the filing of a land use referendum has expired or
1763 until the applicant can demonstrate that the qualifying project
1764 is not the subject of any land use referendum or initiative.
1765 In awarding a matching grant under this item, Go Utah
1766 shall make rules in accordance with Title 63G, Chapter 3, Utah
1767 Administrative Rulemaking Act, establishing the eligibility and
1768 reporting criteria for an applicant to receive a matching grant,
1769 including: (1) the form and process of applying for a matching
1770 grant; (2) the method and formula for determining grant
1771 amounts; and (3) the reporting requirements of grant recipients.
1772 Go Utah shall provide a report describing the distribution
1773 and uses of the grant money to the Governor's Office of
1774 Planning and Budget and to the Office of the Legislative Fiscal
1775 Analyst. Additionally, Go Utah shall include information
1776 describing the distribution and use of the grant money in the
1777 office's annual report currently described in Section
1778 63N-1a-306.

2279 $1,000,000 one-time for Salt Lake County; (b) $800,000
2280 one-time for Washington County; and (c) $553,300 for Davis
2281 and Weber Counties.
2282 The Legislature intends that the additional ongoing funding
2283 appropriated to the Department of Health and Human Services
2284 for the purpose of enhancing Medicaid Accountable Care
2285 Organization rates be used to pay ACO rates up to actuarially
2286 certified rates approved by the Centers for Medicare and
2287 Medicaid Services. If the Department is unable to establish
2288 actuarially certified rates through the CMS rate-setting process
2289 for SFY 2023 ACO rates, then it shall incorporate 2019 data,
2290 commitments from the ACOs to spend a portion of these funds
2291 on increased provider payments and/or other mutually
2292 agreeable strategies to facilitate rate approval.

3218 The Legislature intends that the Department of
3219 Transportation use $5,000,000 appropriated to the
3220 Transportation Investment Fund by this item to conduct an
3221 environmental analysis for an interchange at US-6 and Spanish
3222 Fork Center Street.
3223 The Legislature intends that the Department of
3224 Transportation use $10,000,000 appropriated by this item for
3225 the extension of 9000 S in Salt Lake County at the Mountain
3226 View Corridor.
3227 The Legislature intends that the Department of
3228 Transportation use the $30,000,000 appropriated by this item
3229 for paved pedestrian or paved nonmotorized transportation
3230 projects, contingent on the political subdivision in which a
3231 project is located contributing equal to or greater than 20
3232 percent of the costs for construction, reconstruction, or
3233 renovation of the paved pedestrian or paved nonmotorized
3234 transportation project.
3235 The Legislature intends that as projects are prioritized from
3236 funds appropriated to the Transportation Investment Fund by
3237 this item, the Transportation Commission consider highway
3238 projects as they are currently ranked by the Department of
3239 Transportation, that the Commission disperse projects
3240 statewide geographically, and that the Commission consider
3241 projects beyond the normal programming horizon.
3242 The Legislature intends that the Department of
3243 Transportation transfer $35,000,000 from funds provided in
3244 Item 1, Chapter 387, Laws of Utah 2021, to the Mountainland
3245 Association of Governments to reimburse local funds
3246 previously expended on state highway projects.
3247 The Legislature intends that the Department of
3248 Transportation use $5,000,000 appropriated to the
3249 Transportation Investment Fund to conduct an environmental
3250 analysis and preliminary engineering for an interchange on
3251 I-84 in Mountain Green.

3256 The Legislature intends that the Department of
3257 Transportation use $75,000,000 appropriated by this item to
3258 double track strategic sections of the Front Runner commuter
3259 rail system and may use up to $5,000,000 of this appropriation
3260 for planning and environmental analysis to extend Front
3261 Runner to Payson, including station area planning as
3262 appropriate.
3263 The Legislature intends that the Department of
3264 Transportation use $75,000,000 appropriated by this item for a
3265 future transit project at the Point of the Mountain. The
3266 Department of Transportation will complete the alternative
3267 analysis that will include both rail and bus rapid transit options
3268 for consideration of final plan.
3269 The Legislature intends that the Department of
3270 Transportation use funds appropriated from the Transit
3271 Transportation Investment Fund for oversight of a project to
3272 strategically double track commuter rail lines and a project to
3273 develop and construct public transit facilities and related
3274 infrastructure pertaining to the Point of the Mountain State
3275 Land Authority.
3276 Section 3. FY 2023 Appropriations Limit Formula.
3277 The state appropriations limit for a given fiscal year, FY, shall be calculated by
3278 , where:
3279 (a) ;
3280 (b) ;
3281 (c) ;
3282 (d) ; and
3283 (e) as used in the state appropriations limit formula:
3284 (i) i is a variable representing a given fiscal year;
3285 (ii) is the net adjustments to the state appropriations limit for a given fiscal year due
3286 to program or service adjustments, as required under Section 63J-3-203;
3287 (iii) is the state capital and operations appropriations from the General
3288 Fund and non-Uniform School fund in fiscal year 1985;
3289 (iv) is the amount the state paid in debt payments in fiscal year 1985;
3290 (v) is the average of the quarterly values of the Gross National Product
3291 Implicit Price Deflator for the fiscal year two fiscal years before FY, as published by the United
3292 States Federal Reserve by January 31 of each year;
3293 (vi) is the average of the quarterly values of the Gross National Product
3294 Implicit Price Deflator for a given fiscal year, as measured by the Gross National Product Implicit
3295 Price Deflator from the vintage series published by the United States Department of Commerce on
3296 January 26, 1990;
3297 (vii) is the change in the general price level of goods and services nationally
3298 from 1983 to two fiscal years before a given fiscal year, as measured by the most current Gross
3299 National Product Implicit Price Deflator series published by the United States Federal Reserve,
3300 adjusted to a 1989 basis;
3301 (viii) is the amount of real per capita state appropriations for fiscal
3302 year 1985; and
3303 (ix) is:
3304 (A) the population as of July 1 in the fiscal year two fiscal years before a given fiscal year,
3305 as estimated by the United States Census Bureau by January 31 of each year; or
3306 (B) if the estimate described in Subsection (3)(e)(ix)(A) is not available, an amount
3307 determined by the Governor's Office of Management and Budget, estimated by adjusting an
3308 available April 1 decennial census count or by adjusting a fiscal year population estimate available
3309 from the United States Census Bureau.
3310 Section 4. Effective Date.
3311 If approved by two-thirds of all the members elected to each house, Section 1 of this bill
3312 takes effect upon approval by the Governor, or the day following the constitutional time limit of
3313 Utah Constitution Article VII, Section 8 without the Governor's signature, or in the case of a veto,
3314 the date of override. Section 2 and Section 3 of this bill take effect on July 1, 2022.
