7     LONG TITLE
8     General Description:
9          This bill amends provisions related to inspection of vehicle identification numbers.
10     Highlighted Provisions:
11          This bill:
12          ▸     allows certain other parties to perform vehicle identification number inspections if
13     an applicant shows that a vehicle identification inspection is impractical given the
14     circumstances; and
15          ▸     makes technical changes.

24     Be it enacted by the Legislature of the state of Utah:
25          Section 1. Section 41-1a-802 is amended to read:
26          41-1a-802. Identification number inspectors -- Duties.
27          (1) The following are qualified identification number inspectors:
28          (a) the commission;
29          (b) designated officers and employees of the division;

30          (c) a person operating a safety inspection station under Title 53, Chapter 8, Part 2,
31     Motor Vehicle Safety Inspection Act;
32          (d) an official inspection station certified inspector;
33          (e) a dealer licensed under Subsection 41-3-202(1), (2), (3), or (4); [and]
34          (f) all peace officers or designated employees of law enforcement agencies of the
35     state[.];
36          (g) all peace officers of the federal government, another state, the District of Columbia,
37     or Canada; or
38          (h) other qualified identification number inspectors expressly authorized by the
39     division.
40          (2) The qualified identification number inspectors shall, upon the application for the
41     first title or registration in this state of any vehicle:
42          (a) physically inspect the identification number of the vehicle;
43          (b) make a record of the identification number inspection [upon an application] on a
44     form [provided] approved by the division; and
45          (c) verify the facts in the application.
46          (3) If an applicant demonstrates to the satisfaction of the division that it is not practical
47     for a vehicle identification number to be physically inspected by a qualified inspector described
48     in Subsection (1), the division may authorize a physical inspection by an alternative
49     identification number inspector described in Subsection (4).
50          (4) The following are alternative vehicle identification number inspectors:
51          (a) an officer or employee of an agency or instrumentality of another state, the District
52     of Columbia, or Canada, if that agency or instrumentality enforces the motor vehicle laws of
53     another state, the District of Columbia, or Canada;
54          (b) an owner, operator, or employee of a motor vehicle inspection station that is
55     licensed or authorized by another state, the District of Columbia, or Canada to perform safety
56     or emissions inspections;
57          (c) a new or used motor vehicle dealer that is licensed by another state, the District of

58     Columbia, or Canada; or
59          (d) a person the division expressly authorizes in writing to perform a vehicle
60     identification number inspection of a vehicle.
