7     LONG TITLE
8     General Description:
9          This bill enacts provisions related to funding implementation of the Safe Drinking
10     Water Act.
11     Highlighted Provisions:
12          This bill:
13          ▸     defines terms; and
14          ▸     creates the Drinking Water Capacity Account.
15     Money Appropriated in this Bill:
16          This bill appropriates in fiscal year 2023:
17          ▸     to the General Fund Restricted - Drinking Water Capacity Account, as an ongoing
18     appropriation:
19               •     from General Fund, $1,563,300.
20          ▸     to the Department of Environmental Quality -- Drinking Water, as an ongoing
21     appropriation:
22               •     from General Fund Restricted - Drinking Water Capacity Account, $1,563,300.
23     Other Special Clauses:
24          This bill provides a special effective date.

26     ENACTS:

29     Be it enacted by the Legislature of the state of Utah:
30          Section 1. Section 19-4-115 is enacted to read:
31          19-4-115. Drinking Water Capacity Account.
32          (1) As used in this section, "account" means the Drinking Water Capacity Account
33     created in this section.
34          (2) There is created a restricted account in the General Fund known as the "Drinking
35     Water Capacity Account."
36          (3) (a) The account consists of:
37          (i) appropriations of the Legislature; and
38          (ii) interest and earnings earned on the account.
39          (b) The Office of the Treasurer shall deposit interest and other earnings derived from
40     investment of money in the account into the account.
41          (4) Subject to appropriation by the Legislature, the division may use the money in the
42     account to implement this chapter, including to:
43          (a) assist a public water system in meeting drinking water standards;
44          (b) provide direct technical assistance and training to a public water system;
45          (c) assist a public water system in planning for and serving future growth; and
46          (d) review an application for a new public water system, expansion of a public water
47     system, or upgrade of a public water system.
48          Section 2. Appropriation.
49          The following sums of money are appropriated for the fiscal year beginning July 1,
50     2022, and ending June 30, 2023. These are additions to amounts previously appropriated for
51     fiscal year 2023.
52          Subsection (2)(a). Restricted Fund and Account Transfers.
53          The Legislature authorizes the State Division of Finance to transfer the following
54     amounts between the following funds or accounts as indicated. Expenditures and outlays from
55     the funds to which the money is transferred must be authorized by an appropriation.

61          Subsection (2)(b). Operating and Capital Budgets.
62          Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, the
63     Legislature appropriates the following sums of money from the funds or accounts indicated for
64     the use and support of the government of the state of Utah.
