7     LONG TITLE
8     General Description:
9          This bill amends the fees for jurors and witnesses.
10     Highlighted Provisions:
11          This bill:
12          ▸     amends the fees for jurors and witnesses; and
13          ▸     makes technical and conforming changes.
14     Money Appropriated in this Bill:

16     Other Special Clauses:
17          This bill provides a special effective date.

22     Be it enacted by the Legislature of the state of Utah:
23          Section 1. Section 78B-1-119 is amended to read:
24          78B-1-119. Jurors and witnesses -- Fees and mileage.
25          (1) Every juror and witness legally required or in good faith requested to attend a trial

26     court of record or not of record or a grand jury is entitled to:
27          (a) for a juror, $18.50 for the first day of attendance and $49 per day for each
28     subsequent day of attendance; [and]
29          (b) for a witness, $40 for the first day of attendance and $49 per day for each
30     subsequent day of attendance; and
31          [(b)] (c) if traveling more than 50 miles, $1 for each four miles in excess of 50 miles
32     actually and necessarily traveled in going only, regardless of county lines.
33          (2) [Persons] An individual in the custody of a penal institution upon conviction of a
34     criminal offense [are] is not entitled to a witness fee.
35          (3) A witness attending from outside the state in a civil case is allowed mileage at the
36     rate of 25 cents per mile and is taxed for the distance actually and necessarily traveled inside
37     the state in going only.
38          (4) If the witness is attending from outside the state in a criminal case, the state shall
39     reimburse the witness under Section 77-21-3.
40          (5) A prosecution witness or a witness subpoenaed by an indigent defendant attending
41     from outside the county but within the state may receive reimbursement for necessary lodging
42     and meal expenses under rule of the Judicial Council.
43          (6) A witness subpoenaed to testify in court proceedings in a civil action shall receive
44     reimbursement for necessary and reasonable parking expenses from the attorney issuing the
45     subpoena under rule of the Judicial Council or Supreme Court.
46          Section 2. Effective date.
47          This bill takes effect on July 1, 2022.
