8 General Description:
9 This bill modifies provisions of the Animal Welfare Act.

23 Be it enacted by the Legislature of the state of Utah:
24 Section 1. Section 11-46-401 is enacted to read:

26 11-46-401. Definitions -- Limitations on pet store regulations.
27 (1) As used in this part, "retail pet store" means a place of business within a political
28 subdivision where a seller, buyer, and an animal for sale as a pet are physically present so that a
29 buyer may personally observe the animal prior to purchasing.
30 (2) A political subdivision may not make or enforce an ordinance or other regulation
31 that requires a retail pet store to only sell an animal that was obtained from an animal shelter or
32 similar entity.
