8 General Description:
9 This bill identifies circumstances where it is a crime to fail to aid a crime victim.
10 Highlighted Provisions:
11 This bill:
12 ▸ identifies circumstances where it is a crime to fail to aid a crime victim;
13 ▸ prohibits distribution of a recording of the crime unless the crime has been reported
14 to law enforcement; and
15 ▸ provides that the Good Samaritan statute applies if the person provides assistance to
16 the victim.

25 Be it enacted by the Legislature of the state of Utah:
26 Section 1. Section 76-9-703.1 is enacted to read:
27 76-9-703.1. Failure to aid a crime victim.
28 (1) As used in this section, "distribute" means to sell, exhibit, display, provide, give,
29 grant admission to, provide access to, post, or otherwise transfer or present an image to another
30 individual.
31 (2) An actor commits the offense of failure to aid a crime victim if the actor:
32 (a) witnesses a felony in progress being committed against another individual;
33 (b) knows that the victim is in need of immediate assistance;
34 (c) fails to either:
35 (i) summon law enforcement or other assistance; or
36 (ii) provide assistance to the victim;
37 (d) intentionally creates a record of all or part of a felony in progress against another
38 individual through visual depiction, photograph, film, video, recording, or picture; and
39 (e) distributes the record to someone other than law enforcement.
40 (3) A violation of Subsection (2) is a class B misdemeanor.
41 (4) Notwithstanding Subsection (2), an actor is not guilty of failure to aid a crime
42 victim if, prior to distributing the record, the actor reports the felony to law enforcement or
43 reasonably believes that another individual has reported the felony to law enforcement.
44 (5) An individual who provides aid to a victim under this section is immune from civil
45 liability under the provisions of Section 78B-4-501.
