23 Be it enacted by the Legislature of the state of Utah:
24 Section 1. Section 73-1-22 is enacted to read:
25 73-1-22. Releases from dam or reservoir.
26 (1) As used in this section, "applicable dam or reservoir" means a dam or reservoir on
27 the Provo River or Weber River.
28 (2) (a) Subject to Subsection (2)(b) and except in the case of an emergency, an operator
29 of an applicable dam or reservoir may not increase the flow rate of the applicable dam or
30 reservoir in an amount that is greater than 25% of the total flow every 15 minutes within a
31 natural channel.
32 (b) When an operator increases the flow rate of an applicable dam from a point of no
33 release, the operator may make the first release to a minimum safe level for the applicable dam
34 facility and then shall comply with Subsection (2)(a).
35 (3) This section applies to a federally owned dam or reservoir when a nonfederal
36 operator is contractually responsible for the operation and maintenance of the federally owned
37 dam or reservoir, unless compliance with this section puts the nonfederal operator in breach of
38 the contract.
