8 General Description:
9 This bill modifies a provision of the Open and Public Meetings Act relating to criminal
10 penalties.
11 Highlighted Provisions:
12 This bill:
13 ▸ imposes a criminal penalty on a public body member who excludes from an open
14 meeting a member of the public entitled to attend the meeting.

23 Be it enacted by the Legislature of the state of Utah:
24 Section 1. Section 52-4-305 is amended to read:
25 52-4-305. Criminal penalty for certain violations.
26 In addition to any other penalty under this chapter[
27 (1) a member of a public body who knowingly or intentionally violates or who
28 knowingly or intentionally abets or advises a violation of any of the closed meeting provisions
29 of this chapter is guilty of a class B misdemeanor[
30 (2) subject to Section 52-4-301, a member of a public body who knowingly or
31 intentionally excludes from an open meeting a member of the public who has a right to attend
32 the open meeting is guilty of a class C misdemeanor.
