7     LONG TITLE
8     General Description:
9          This bill addresses the creation of Monte Cristo State Park.
10     Highlighted Provisions:
11          This bill:
12          ▸     authorizes the Division of State Parks to accept donations of land or facilities,
13     engage in land transfers, and purchase land and facilities for the creation of Monte
14     Cristo State Park;
15          ▸     provides that Monte Cristo State Park shall be included in the state parks system;
16          ▸     provides that Monte Cristo State Park may not be opened to the public until the
17     division receives sufficient funds for capital improvements;
18          ▸     provides that any land acquisitions or capital improvements shall be done in a way
19     that will make the park self-sustaining; and
20          ▸     provides for on-going operational funding for the park from the division's restricted
21     fees account.
22     Money Appropriated in this Bill:
23          This bill appropriates in fiscal year 2023:
24          ▸     to the Division of Parks, as a one-time appropriation:
25               •     from the General Fund, One-time, $20,000,000; and
26          ▸     to the Division of Parks, as an on-going appropriation:
27               •     from the General Fund, On-going, $450,000.

34     Be it enacted by the Legislature of the state of Utah:
35          Section 1. Section 79-4-609 is enacted to read:
36          79-4-609. Monte Cristo State Park.
37          (1) As used in this section, "Monte Cristo" means the land located in the area known as
38     Monte Cristo and more fully described by the map and legal description on file with the
39     division.
40          (2) The division may:
41          (a) accept donations of land or facilities in the Monte Cristo area for the creation of,
42     and inclusion within, Monte Cristo State Park;
43          (b) engage in land transfers for land in the Monte Cristo area for inclusion in Monte
44     Cristo State Park; and
45          (c) purchase land or facilities in the Monte Cristo area for inclusion in Monte Cristo
46     State Park.
47          (3) Monte Cristo State Park shall be included within the state park system.
48          (4) The division may not open Monte Cristo State Park to the public for use as a state
49     park until the division receives sufficient funding from the state building board or from
50     appropriations by the Legislature to make capital improvements and necessary land
51     acquisitions for the park.
52          (5) The division shall make land acquisitions and capital investments for Monte Cristo
53     State Park in a way that will allow Monte Cristo State Park to be financially self-sustaining.
54          (6) Ongoing operations at Monte Cristo State Park shall be funded through the
55     division's restricted fees account.
56          Section 2. Appropriation.
57          The following sums of money are appropriated for the fiscal year beginning July 1,
58     2022, and ending June 30, 2023. These are additions to the amounts previously appropriated

59     for fiscal year 2023. Under the terms and conditions of Title 63J, Chapter 1, Budgetary
60     Procedures Act, the Legislature appropriates the following sums of money from the funds or
61     accounts indicated for the use and support of the government of the state of Utah.

70          (1) Under Section 63J-1-603, the Legislature intends that appropriations provided
71     under this item not lapse at the close of fiscal year 2023.
72          (2) The use of any non-lapsing funds is limited to the development of Monte Cristo
73     State Park.
74          (3) The Legislature intends that the Division of State Parks use funds appropriated
75     from the State Park Fees Restricted Account to purchase up to two vehicles for operations at
76     Monte Cristo State Park.
