7     LONG TITLE
8     General Description:
9          This bill codifies five-year performance goals for the Utah System of Higher Education
10     and each institution of higher education.
11     Highlighted Provisions:
12          This bill:
13          ▸     codifies five-year performance goals set by the Utah Board of Higher Education for
14     the Utah System of Higher Education and each institution of higher education;
15          ▸     provides a repeal date requiring committee review for provisions codifying the
16     five-year goals; and
17          ▸     defines terms.

28     Be it enacted by the Legislature of the state of Utah:
29          Section 1. Section 53B-7-709 is enacted to read:

30          53B-7-709. Five-year performance goals.
31          (1) As used in this section:
32          (a) "Access metric" means the metric described in Subsection 53B-7-706(2)(a)(ii)(A).
33          (b) "Award" means a degree or certificate that an institution grants.
34          (c) "Cohort" means a group of students, defined by the year in which the group enrolls
35     in an institution.
36          (d) "Five-year performance period" means the five-year period beginning on July 1,
37     2022, and ending on June 30, 2027.
38          (e) "High-yield award" means the same as that term is defined in board policy under
39     Subsection 53B-7-706(2)(c).
40          (f) "High-yield awards metric" means the metric described in Subsection
41     53B-7-706(2)(a)(ii)(C).
42          (g) "Institution" means an institution of higher education described in Section
43     53B-1-102.
44          (h) "Standard completion time" means the time in which a student typically completes
45     an award program.
46          (i) "System" means the Utah System of Higher Education.
47          (j) "Timely completion metric" means the metric described in Subsection
48     53B-7-706(2)(a)(ii)(B).
49          (2) The goals established by the board in accordance with Subsection
50     53B-7-706(1)(a)(ii) for the Utah System of Higher Education for the five-year performance
51     period are:
52          (a) for the access metric, to increase the percent of Utah high school graduates
53     participating in the system by 3.0%;
54          (b) for the timely completion metric, to increase the system percentage of a cohort that
55     completes an award in up to and including 1.5 times the standard completion time by 3.0%;
56     and
57          (c) for the high-yield awards metric, to increase the system percentage of high-yield

58     awards by 3.0%.
59          (3) In order to meet the system goals described in Subsection (2), the goals for each
60     institution for the five-year performance period are:
61          (a) for the access metric, to increase the institution's share of Utah high school
62     graduates participating in the system by a percentage that the board determines;
63          (b) for the timely completion metric, to increase the percent of a cohort enrolled at the
64     institution that completes an award in up to and including 1.5 times the standard completion
65     time or sooner by a percentage that the board determines; and
66          (c) for the high-yield awards metric, to increase the percent of high-yield awards the
67     institution grants by a percentage that the board determines.
68          Section 2. Section 63I-1-253 is amended to read:
69          63I-1-253. Repeal dates, Titles 53 through 53G.
70          (1) Section 53-2a-105, which creates the Emergency Management Administration
71     Council, is repealed July 1, 2022.
72          (2) Sections 53-2a-1103 and 53-2a-1104, which create the Search and Rescue Advisory
73     Board, are repealed July 1, 2022.
74          (3) Section 53-5-703, which creates the Concealed Firearm Review Board, is repealed
75     July 1, 2023.
76          (4) Subsection 53-6-203(1)(b)(ii), regarding being 19 years old at certification, is
77     repealed July 1, 2027.
78          (5) Subsection 53-13-104(6)(a), regarding being 19 years old at certification, is
79     repealed July 1, 2027.
80          (6) Section 53B-6-105.5, which creates the Technology Initiative Advisory Board, is
81     repealed July 1, 2024.
82          (7) Section 53B-7-709, regarding five-year performance goals for the Utah System of
83     Higher Education, is repealed July 1, 2027.
84          [(7)] (8) Title 53B, Chapter 17, Part 11, USTAR Researchers, is repealed July 1, 2028.
85          [(8)] (9) Section 53B-17-1203, which creates the SafeUT and School Safety

86     Commission, is repealed January 1, 2025.
87          [(9)] (10) Title 53B, Chapter 18, Part 16, USTAR Researchers, is repealed July 1,
88     2028.
89          [(10)] (11) Title 53B, Chapter 24, Part 4, Rural Residency Training Program, is
90     repealed July 1, 2025.
91          [(11)] (12) Subsection 53C-3-203(4)(b)(vii), which provides for the distribution of
92     money from the Land Exchange Distribution Account to the Geological Survey for test wells
93     and other hydrologic studies in the West Desert, is repealed July 1, 2030.
94          (13) Subsections 53E-3-503(5) and (6), which create coordinating councils for youth in
95     custody, are repealed July 1, 2027.
96          [(12)] (14) Section 53E-3-515 is repealed January 1, 2023.
97          [(13)] (15) In relation to a standards review committee, on January 1, 2023:
98          (a) in Subsection 53E-4-202(8), the language "by a standards review committee and the
99     recommendations of a standards review committee established under Section 53E-4-203" is
100     repealed; and
101          (b) Section 53E-4-203 is repealed.
102          [(14) Subsections 53E-3-503(5) and (6), which create coordinating councils for youth
103     in custody, are repealed July 1, 2027.]
104          [(15)] (16) Section 53E-4-402, which creates the State Instructional Materials
105     Commission, is repealed July 1, 2022.
106          [(16)] (17) Title 53E, Chapter 6, Part 5, Utah Professional Practices Advisory
107     Commission, is repealed July 1, 2023.
108          [(17) Subsection 53E-8-204(4), which creates the advisory council for the Utah
109     Schools for the Deaf and the Blind, is repealed July 1, 2021.]
110          (18) Section 53F-2-420, which creates the Intensive Services Special Education Pilot
111     Program, is repealed July 1, 2024.
112          (19) Section 53F-5-203 is repealed July 1, 2024.

122          [(26)] (25) Subsections 53G-4-608(2)(b) and (4)(b), related to the Utah Seismic Safety
123     Commission, are repealed January 1, 2025.
124          [(27)] (26) Subsection 53G-8-211(5), regarding referrals of a minor to court for a class
125     C misdemeanor, is repealed July 1, 2022.
