7     LONG TITLE
8     General Description:
9          This bill creates the Missing Child Identification Program to be administered by the
10     attorney general.
11     Highlighted Provisions:
12          This bill:
13          ▸     creates the Missing Child Identification Program to be administered by the attorney
14     general to provide a fingerprint and DNA collection kit to a parent or legal guardian
15     of a child entering kindergarten.

24     Be it enacted by the Legislature of the state of Utah:
25          Section 1. Section 67-5-38 is enacted to read:
26          67-5-38. Missing Child Identification Program.
27          (1) As used in this section:
28          (a) "Kit" means a fingerprint and DNA identification kit that may be used to collect
29     and store fingerprint and DNA information.

30          (b) "Program" means the Missing Child Identification Program created in this section.
31          (2) (a) There is created the Missing Child Identification Program to be administered by
32     the attorney general as described in this section.
33          (b) The purpose of the program is to provide a kit to a parent or legal guardian of a
34     kindergarten student, to be distributed by the student's elementary school, which the parent or
35     guardian may use to collect and store a child's fingerprint and DNA information for potential
36     use by law enforcement in the event that the child is missing.
37          (c) If the Legislature does not appropriate funds specifically for the program, the
38     attorney general may implement the program using other available appropriations.
39          (3) (a) The attorney general shall provide kits to each Utah elementary school to be
40     distributed to the parent or legal guardian of each student entering kindergarten in the
41     elementary school.
42          (b) The attorney general shall obtain the kits in compliance with Title 63G, Chapter 6a,
43     Utah Procurement Code.
44          (c) The kits described in Subsection (3)(a) may be delivered to an elementary school
45     directly through the supplier of the kits.
46          (d) The State Board of Education, or the State Board of Education's designee, shall
47     coordinate with the attorney general to determine how many kits are needed each year at each
48     elementary school.
49          (e) An elementary school that receives a supply of kits shall offer a kit to a parent or
50     legal guardian for a student entering kindergarten at the elementary school.
51          (4) The attorney general may make rules in accordance with Title 63G, Chapter 3, Utah
52     Administrative Rulemaking Act, to carry out the program.
53          Section 2. Effective date.
54          This bill takes effect on July 1, 2022.
