7     LONG TITLE
8     General Description:
9          This bill enacts provisions related to the Medicaid program.
10     Highlighted Provisions:
11          This bill:
12          ▸     prohibits the Medicaid program from paying for home health services unless the
13     provider of the services has liability insurance.
14     Money Appropriated in this Bill:
15          None
16     Other Special Clauses:
17          This bill provides a special effective date.

20          26-18-5.5, Utah Code Annotated 1953

22     Be it enacted by the Legislature of the state of Utah:
23          Section 1. Section 26-18-5.5 is enacted to read:
24          26-18-5.5. Liability insurance required.
25          The Medicaid program may not reimburse a home health agency, as defined in Section
26     26-21-2, for home health services provided to an enrollee unless the home health agency has
27     liability coverage of:
28          (1) at least $500,000 per incident; or
29          (2) an amount established by department rule made in accordance with Title 63G,

30     Chapter 3, Utah Administrative Rulemaking Act.
31          Section 2. Effective date.
32          This bill takes effect on July 1, 2022.
