30     Be it enacted by the Legislature of the state of Utah:
31          Section 1. Section 26B-1-201 is amended to read:
32          26B-1-201. Department of Health and Human Services -- Creation -- Duties.
33          (1) There is created within state government the Department of Health and Human
34     Services, which has all of the policymaking functions, regulatory and enforcement powers,
35     rights, duties, and responsibilities outlined in this title.
36          [(2) In addition to Subsection (1), during the transition period described in Section
37     26B-1-201.1, the Department of Health and Human Services may exercise any of the
38     policymaking functions, regulatory and enforcement powers, rights, duties, and responsibilities
39     of the Department of Health and the Department of Human Services under the joint direction
40     of:]
41          [(a) the executive director of the Department of Health; and]
42          [(b) the executive director of the Department of Human Services.]
43          (2) (a) The chief administrative officer of the department is the executive director who
44     shall be appointed by the governor with the advice and consent of the Senate.
45          (b) The executive director shall serve at the pleasure of the governor.
46          (c) The governor shall establish the executive director's salary within the salary range
47     fixed by the Legislature in Title 67, Chapter 22, State Officer Compensation.
48          Section 2. Section 26B-1-202 is enacted to read:
49          26B-1-202. Divisions within the Department of Health and Human Services.
50          There is created within the department the following divisions:
51          (1) within the section on Operations:
52          (a) the Division of Finance and Administration, which shall include:
53          (i) the Office of Administrative Services;
54          (ii) the Office of Budget and Fiscal Policy; and
55          (iii) the Office of Contract Management and Procurement;
56          (b) the Division of Licensing and Background Checks, which shall include:
57          (i) the Office of Licensing; and
58          (ii) the Office of Background Checks and Processing;

59          (c) the Division of Customer Experience, which shall include:
60          (i) the Office of the Ombudsman; and
61          (ii) the Office of Connection and Navigation; and
62          (d) the Division of Data, Systems, and Evaluation, which shall include:
63          (i) the Office of Data Security and Privacy;
64          (ii) the Office of Research and Evaluation; and
65          (iii) the Office of Vital Records;
66          (2) within the section on Health Care Administration:
67          (a) the Division of Integrated Health Care, which shall include:
68          (i) the state Medical Assistance Programs;
69          (ii) the Office of Behavioral Health Treatment and Crisis Response; and
70          (iii) the Utah State Hospital;
71          (b) the Division of Aging and Adult Services, which shall include the Office of the
72     Public Guardian; and
73          (c) the Division of Services for People With Disabilities, which shall include the Utah
74     State Developmental Center; and
75          (3) within the section on Community Health and Well Being:
76          (a) the Division of Children and Family Services, which shall include:
77          (i) the Office of Children with Special Health Needs;
78          (ii) the Office of Coordinated Care and Regional Supports; and
79          (iii) the Office of Maternal and Child Health;
80          (b) the Division of Juvenile Justice and Youth Services; and
81          (c) the Division of Population Health, which shall include:
82          (i) the Office of Communicable Diseases and Emerging Infections;
83          (ii) the Office of Integrated Health Promotion and Prevention; and
84          (iii) the Office of Preparedness and Emergency Health.
85          Section 3. Repealer.
86          This bill repeals:
87          Section 26B-1-201.1, Transition to single state agency -- Transition plan --
88     Restricted Account.
