9     General Description:
10          This bill enacts a salary supplement for certified school athletic directors.
11     Highlighted Provisions:
12          This bill:
13          ▸     defines terms;
14          ▸     directs the Legislature to annually appropriate money for salary supplements for a
15     certified athletic director and certified master athletic director;
16          ▸     includes in money appropriated for a salary supplement employer-paid benefits;
17          ▸     requires the State Board of Education to create an application and determine
18     whether an applicant qualifies for a salary supplement; and
19          ▸     requires an athletic director to hold a current certificate and apply to the State Board
20     of Education in order to receive the salary supplement.

29     Be it enacted by the Legislature of the state of Utah:
30          Section 1. Section 53F-2-524 is enacted to read:
31          53F-2-524. Salary supplement for certified athletic directors.
32          (1) As used in this section:
33          (a) "Athletic administrator certification" means a current athletic administrator
34     certificate issued by the National Interscholastic Athletic Administrators Association.
35          (b) "Athletic director" means an LEA employee whose primary duty is to supervise the
36     administration of athletic activities in a public school in grades 10, 11, or 12.
37          (c) "Certified athletic director" means an athletic director who holds an athletic
38     administrator certification.
39          (d) "Certified master athletic director" means an athletic director who holds a master
40     athletic administrator certification.
41          (e) "Master athletic administrator certification" means a current master athletic
42     administrator certificate issued by the National Interscholastic Athletic Administrators
43     Association.
44          (f) "Salary supplement" means a salary supplement for a certified athletic director or
45     certified master athletic director described in this section.
46          (2) (a) Subject to future budget constraints, the Legislature shall:
47          (i) annually appropriate money to maintain annual salary supplements provided in
48     previous years; and
49          (ii) provide salary supplements to new recipients.
50          (b) Money appropriated for salary supplements shall include money for the following
51     employer-paid benefits:
52          (i) retirement;
53          (ii) workers' compensation;
54          (iii) Social Security; and
55          (iv) Medicare.
56          (3) (a) The annual salary supplement for a certified athletic director is $2,500.
57          (b) The annual salary supplement for a certified master athletic director is $5,000.
58          (c) An athletic director who qualifies for a salary supplement under Subsections (3)(a)

59     and (b) may only receive the salary supplement that is greater in value.
60          (d) The employer paid benefits described in Subsection (2)(b) are in addition to an
61     amount described in this Subsection (3).
62          (4) The state board shall:
63          (a) create an online application system for an athletic director to apply to receive a
64     salary supplement;
65          (b) establish a deadline by which an athletic director is required to apply in order to
66     receive a salary supplement;
67          (c) determine whether an athletic director who applies for a salary supplement is a
68     certified athletic director or certified master athletic director;
69          (d) verify, as needed, a determination made under Subsection (4)(c) with LEA or
70     school administrators; and
71          (e) certify an annual list of certified athletic directors and certified master athletic
72     directors.
73          (5) To receive a salary supplement, a certified athletic director or certified master
74     athletic director shall apply to the state board before the deadline described in Subsection
75     (4)(b).
76          (6) The state board shall establish and administer an appeal process for an athletic
77     director who applies for but does not receive a salary supplement that allows the athletic
78     director to appeal eligibility by providing evidence to the state board of the athletic director's:
79          (a) athletic director certification; or
80          (b) master athletic director certification.
81          (7) The state board shall:
82          (a) distribute money appropriated for salary supplements to LEAs in accordance with
83     the provisions of this section; and
84          (b) include the cost of employer-paid benefits described in Subsection (2)(b) in the
85     amount distributed to an LEA for each salary supplement.
86          (8) (a) An LEA shall use money received under this section to provide a salary
87     supplement to each certified athletic director and each certified master athletic director in an
88     amount equal to the amount described in Subsection (3).
89          (b) A salary supplement is part of an athletic director's base pay, subject to the athletic

90     director's qualification as a certified athletic director or certified master athletic director every
91     year, semester, or trimester.
92          (9) Notwithstanding the provisions of this section, if an annual appropriation for salary
93     supplements is not sufficient to cover the costs associated with salary supplements, the state
94     board shall distribute the funds on a pro rata basis.
