7     LONG TITLE
8     General Description:
9          This bill modifies provisions related to horse racing.
10     Highlighted Provisions:
11          This bill:
12          ▸     defines terms;
13          ▸     addresses the Horse Racing Account, including sources of revenues for the account
14     and the purposes for which money in the account may be used; and
15          ▸     makes technical changes.
16     Money Appropriated in this Bill:
17          This bill appropriates in fiscal year 2023:
18          ▸     to General Fund Restricted -- Horse Racing Account, as an ongoing appropriation:
19               •     from the General Fund, $2,000,000.
20     Other Special Clauses:
21          This bill provides a special effective date.

27     Be it enacted by the Legislature of the state of Utah:

28          Section 1. Section 4-38-102 is amended to read:
29          4-38-102. Definitions.
30          As used in this chapter:
31          (1) (a) "Breeder award" means money distributed by the commission to promote the
32     improved breeding and development of the horse industry in Utah.
33          (b) "Breeder award" includes a purse enhancement of races of Utah bred horses.
34          [(1)] (2) "Commission" means the Utah Horse Racing Commission created by this
35     chapter.
36          [(2)] (3) "Executive director" means the executive director of the commission.
37          [(3)] (4) "Mixed meet" means a race meet that includes races by more than one breed
38     of horse.
39          (5) "Purse" means the prize money divided among the owners of horses that finish in
40     specified positions in a race.
41          [(4)] (6) "Race meet" means the entire period of time for which a licensee has been
42     approved to hold horse races.
43          [(5)] (7) "Racetrack facility" means a racetrack within Utah approved by the
44     commission for the racing of horses, including the track surface, grandstands, clubhouse, all
45     animal housing and handling areas, and other areas in which a person may enter only upon
46     payment of an admission fee or upon presentation of authorized credentials.
47          [(6)] (8) "Recognized race meet" means a race meet recognized by a national horse
48     breed association.
49          [(7)] (9) "Utah bred horse" means a horse that is sired by a stallion standing in Utah at
50     the time the dam was bred.
51          Section 2. Section 4-38-402 is amended to read:
52          4-38-402. Horse Racing Account created -- Contents -- Use of account money.
53          (1) There is created within the General Fund a restricted account known as the "Horse
54     Racing Account."
55          (2) The Horse Racing Account consists of:
56          (a) license fees collected under this chapter;
57          (b) revenue from fines imposed under this chapter; [and]
58          (c) appropriations of the Legislature; and

59          [(c)] (d) interest on account money.
60          (3) Upon appropriation by the Legislature, money from the [account] Horse Racing
61     Account shall be used for:
62          (a) in an aggregate amount each fiscal year of no more than 10% of account money, the
63     administration of this chapter, including paying the costs of:
64          [(a)] (i) public liability insurance;
65          [(b)] (ii) stewards;
66          [(c)] (iii) veterinarians; and
67          [(d)] (iv) drug testing[.];
68          (b) in an aggregate amount each fiscal year of at least 50% of account money, the
69     distribution of purses as allocated by the commission in accordance with Section 4-38-401; and
70          (c) in an aggregate amount each fiscal year of at least 40% of account money, the
71     distribution by the commission of breeder awards.
72          Section 3. Appropriation.
73          The following sums of money are appropriated for the fiscal year beginning July 1,
74     2022, and ending June 30, 2023. These are additions to amounts previously appropriated for
75     fiscal year 2023. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
76     Act, the Legislature appropriates the following sums of money from the funds or accounts
77     indicated for the use and support of the government of the state of Utah.
