7     LONG TITLE
8     General Description:
9          This bill creates the Office of Student Health Affairs within the Department of Health
10     and Human Services.
11     Highlighted Provisions:
12          This bill:
13          ▸     defines terms;
14          ▸     creates the Office of Student Health Affairs within the Department of Health and
15     Human Services;
16          ▸     requires the executive director of the Department of Health and Human Services to
17     jointly appoint a director of the Office of Student Health Affairs;
18          ▸     describes qualifications and duties for the director of the Office of Student Health
19     Affairs; and
20          ▸     creates a reporting requirement.

29     Be it enacted by the Legislature of the state of Utah:
30          Section 1. Section 26B-2-1 is enacted to read:

CHAPTER 2. PROGRAMS

32          26B-2-1. Office of Student Health Affairs -- Creation.
33          (1) As used in this section:
34          (a) "Director" means the director of the office appointed under Subsection (3).
35          (b) "School-based health center" means a health clinic that is located in or near a
36     school, is organized through school, community, and health provider relationships, is
37     administered by a sponsoring facility, and provides primary health services to children in
38     accordance with state and local law through health professionals.
39          (2) (a) There is created within the department the Office of Student Health Affairs.
40          (b) The purpose of the office is to oversee and coordinate services provided by the
41     department with public education and higher education systems throughout the state.
42          (3) (a) The executive director of the Department of Health and Human Services shall
43     appoint a director of the office who:
44          (i) has a bachelor's degree from an accredited university or college;
45          (ii) is experienced in administration; and
46          (iii) is knowledgeable about education and health practices.
47          (b) The director is the administrative head of the office and shall serve under the
48     supervision of the executive director.
49          (c) The executive director may hire staff as necessary to carry out the duties of the
50     office described in Subsection (4).
51          (4) The office shall:
52          (a) oversee health services provided by the department for Utah's public education and
53     higher education systems, and coordinate with the State Board of Education, the Department of
54     Education, and the department to increase student health access, including:
55          (i) maintenance and promotion of physical wellness;
56          (ii) mental health services; and
57          (iii) management of chronic health conditions;
58          (b) leverage public and private funding sources to expand the geographic location of

59     communities served by school-based health centers; and
60          (c) establish a plan for cooperation between the State Board of Education and local
61     health departments to minimize redundancy of service delivery and maximize coordination and
62     access to school health services.
63          (5) On or before November 1 of each year, the director shall provide a report to the
64     Health and Human Services Interim Committee and the Education Interim Committee
65     regarding:
66          (a) activities and accomplishments of the office; and
67          (b) recommendations for improving the delivery of student health services.
68          Section 2. Effective date.
69          This bill takes effect on July 1, 2022.
