7     LONG TITLE
8     General Description:
9          This bill enacts provisions related to the COVID-19 Homeless Housing and Services
10     Grant Program.
11     Highlighted Provisions:
12          This bill:
13          ▸     defines terms;
14          ▸     establishes the COVID-19 Homeless Housing and Services Grant Program (grant
15     program);
16          ▸     directs the Office of Homeless Services to administer the program;
17          ▸     directs the Utah Homelessness Council to award grants;
18          ▸     establishes grant criteria; and
19          ▸     requires the state homelessness coordinator to submit an annual report.
20     Money Appropriated in this Bill:
21          This bill appropriates in fiscal year 2023:
22          ▸     to Department of Workforce Services -- Office of Homeless Services, as a one-time
23     appropriation:
24               •     from Federal Funds -- American Rescue Plan, One-time, $127,838,200.

32     Be it enacted by the Legislature of the state of Utah:
33          Section 1. Section 35A-16-401 is enacted to read:

Part 4. COVID-19 Homeless Housing and Services Grant Program

35          35A-16-401. Definitions.
36          As used in this part:
37          (1) "COVID-19" means:
38          (a) severe acute respiratory syndrome coronavirus 2; or
39          (b) the disease caused by severe acute respiratory syndrome coronavirus 2.
40          (2) "COVID-19 emergency" means the spread of COVID-19 that the World Health
41     Organization declared a pandemic on March 11, 2020.
42          (3) "Grant program" means the COVID-19 Homeless Housing and Services Grant
43     Program established in Section 35A-16-402.
44          Section 2. Section 35A-16-402 is enacted to read:
45          35A-16-402. COVID-19 Homeless Housing and Services Grant Program.
46          (1) There is established the COVID-19 Homeless Housing and Services Grant
47     Program, a competitive grant program administered by the office and funded in accordance
48     with 42 U.S.C. Sec. 802.
49          (2) The office shall distribute money to fund one or more projects that:
50          (a) include affordable housing units for households:
51          (i) whose income is no more than 30% of the area median income for households of
52     the same size in the county or municipality where the project is located;
53          (ii) at rental rates no greater than the rates described in Subsection 35A-8-511(2)(b);
54     and
55          (iii) that have been impacted by the COVID-19 emergency in accordance with 42
56     U.S.C. Sec. 802; and

57          (b) have been approved by the homelessness council.
58          (3) The office shall:
59          (a) administer the grant program, including:
60          (i) reviewing grant applications and making recommendations to the homelessness
61     council; and
62          (ii) distributing grant money to approved grant recipients; and
63          (b) in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act,
64     make rules to administer the program, including:
65          (i) grant application requirements;
66          (ii) procedures to approve a grant; and
67          (iii) procedures for distributing money to grant recipients.
68          (4) When reviewing an application for approval, the homelessness council shall
69     consider:
70          (a) an applicant's rental income plan;
71          (b) proposed case management and service plans for households;
72          (c) any matching funds proposed by an applicant;
73          (d) proposed restrictions, including deed restrictions, and the duration of restrictions on
74     housing units to facilitate long-term assistance to households;
75          (e) whether use of funds for the proposed project complies with 42 U.S.C. Sec. 802;
76     and
77          (f) any other considerations as adopted by the council.
78          (5) A grant award under this section shall comply with the requirements of 42 U.S.C.
79     Sec. 802.
80          (6) On or before October 1, the coordinator, in cooperation with the homelessness
81     council shall submit an annual report electronically to the Social Services Appropriations
82     Subcommittee that gives a complete account of the office's disbursement of funds under this
83     section.
84          Section 3. Appropriation.
85          The following sums of money are appropriated for the fiscal year beginning July 1,
86     2022, and ending June 30, 2023. These are additions to amounts previously appropriated for
87     fiscal year 2023. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures

88     Act, the Legislature appropriates the following sums of money from the funds or accounts
89     indicated for the use and support of the government of the state of Utah.

95          The Legislature intends that:
96          (1) under Utah Code Section 63J-1-603, appropriations under this section not lapse at
97     the close of fiscal year 2023; and
98          (2) the use of any nonlapsing funds is limited to the COVID-19 Homeless Housing and
99     Services Grant Program.
