8 General Description:
9 This bill modifies provisions relating to the duties of the state purchasing director.
10 Highlighted Provisions:
11 This bill:
12 ▸ modifies the duties of the state purchasing director relating to the operation,
13 management, and maintenance of the surplus property program;
14 ▸ authorizes the state purchasing director to establish a contract administration
15 service; and
16 ▸ repeals language relating to the state purchasing director's authority to establish
17 microfilming, duplicating, printing, and addressograph services.

26 Be it enacted by the Legislature of the state of Utah:
27 Section 1. Section 63A-2-103 is amended to read:
28 63A-2-103. Duties and authority of purchasing director -- Subscribing to mailing
29 system and electronic central store -- Rate schedule.
30 (1) The purchasing director:
31 (a) shall operate, manage, and maintain:
32 (i) a central mailing service; and
33 (ii) an electronic central store system for procuring goods and services;

40 (i) a contract administration service Ŝ→ , including contract performance surveys ←Ŝ ;

41 (ii) other central services.
42 (2) (a) Each state agency shall Ŝ→ :
42a (i) ←Ŝ subscribe to all of the services described in Subsection
43 (1)(a), unless the director delegates the director's authority to a state agency under Section
44 63A-2-104 Ŝ→ [
44a (ii) complete contract performance surveys as requested by the purchasing director
44b under Subsection (1)(c)(i). ←Ŝ
45 (b) An institution of higher education, the State Board of Education, a school district,
46 or a political subdivision of the state may subscribe to one or more of the services described in
47 Subsection (1)(a).
48 (3) (a) The purchasing director shall:
49 (i) prescribe a schedule of rates to be charged for all services provided by the division
50 after the purchasing director:
51 (A) submits the proposed rates for services provided by the division's internal service
52 fund to the Rate Committee established in Section 63A-1-114; and
53 (B) obtains the approval of the Legislature, as required by Section 63J-1-410;
54 (ii) ensure that the rates are approximately equal to the cost of providing the services;
55 and
56 (iii) annually conduct a market analysis of rates.
57 (b) A market analysis under Subsection (3)(a)(iii) shall include a comparison of the
58 division's rates with the rates of other public or private sector providers if comparable services
59 and rates are reasonably available.
