8     LONG TITLE
9     General Description:
10          This resolution directs the Public Employees' Benefit and Insurance Program (PEHP) to
11     provide fertility preservation coverage.
12     Highlighted Provisions:
13          This resolution:
14          ▸     directs the Public Employees' Benefit and Insurance Program (PEHP) to provide
15     fertility preservation coverage.
16     Special Clauses:
17          None

19     Be it resolved by the Legislature of the state of Utah:
20          WHEREAS, in accordance with Utah Code Section 49-20-201, the state participates in
21     the Public Employees' Benefit and Insurance Program (PEHP);
22          WHEREAS, the Legislature may determine what benefits to offer Utah's state
23     employees;
24          WHEREAS, standard fertility preservation services are procedures to preserve fertility
25     that are consistent with established medical practices or professional guidelines published by

26     the American Society of Clinical Oncology or the American Society for Reproductive
27     Medicine:
28          NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah
29     directs PEHP to provide coverage to state employees and eligible dependents for standard
30     fertility preservation services when a medically necessary gonadotoxic treatment may directly
31     or indirectly cause iatrogenic infertility due to a cancerous condition or a condition that
32     requires a bone marrow transplant.
33          BE IT FURTHER RESOLVED that the coverage shall include consultations,
34     medications, and procedures for cryopreservation.
35          BE IT FURTHER RESOLVED that the coverage shall include the costs of
36     cryopreservation for:
37               • Ĥ→ [
at least] ←Ĥ five years; or
38               •     if the covered individual is younger than 18 years old, until the
39     individual is Ĥ→ [
at least] ←Ĥ 23 years old.
