7     LONG TITLE
8     General Description:
9          This bill addresses the purchase of an electronic duck stamp.
10     Highlighted Provisions:
11          This bill:
12          ▸     authorizes the Division of Wildlife Resources (division) to provide for the purchase
13     of an electronic duck stamp on the division's website;
14          ▸     requires the payment of a fee for the purchase of an electronic duck stamp on the
15     division's website; and
16          ▸     makes technical changes.

27     Be it enacted by the Legislature of the state of Utah:
28          Section 1. Section 23-14-18 is amended to read:
29          23-14-18. Establishment of seasons, locations, limits, and regulations by the

30     Wildlife Board.
31          (1) To provide an adequate and flexible system of protection, propagation,
32     introduction, increase, control, harvest, management, and conservation of protected wildlife in
33     this state and to provide for the use and development of protected wildlife for public recreation
34     and food supply while maintaining a sustainable population of protected wildlife, the Wildlife
35     Board shall determine the circumstances, time, location, means, and the amounts, and numbers
36     of protected wildlife which may be taken.
37          (2) The Wildlife Board shall, except as otherwise specified in this code:
38          (a) fix seasons and shorten, extend, or close seasons on any species of protected
39     wildlife in any locality, or in the entire state, if the board finds that the action is necessary to
40     effectuate proper wildlife management and control;
41          (b) close or open areas to fishing, trapping, or hunting;
42          (c) establish refuges and preserves;
43          (d) regulate and prescribe the means by which protected wildlife may be taken;
44          (e) regulate the transportation and storage of protected wildlife, or their parts, within
45     the boundaries of the state and the shipment or transportation out of the state;
46          (f) establish or change bag limits and possession limits;
47          (g) prescribe safety measures and establish other regulations as may be considered
48     necessary in the interest of wildlife conservation and the safety and welfare of hunters,
49     trappers, fishermen, landowners, and the public;
50          (h) (i) prescribe when licenses, permits, tags, and certificates of registration shall be
51     required and procedures for their issuance and use; and
52          (ii) establish forms and fees for licenses, permits, tags, and certificates of registration;
53     and
54          (i) prescribe rules and regulations as it may consider necessary to control the use and
55     harvest of protected wildlife by private associations, clubs, partnerships, or corporations,
56     provided the rules and regulations do not preclude the landowner from personally controlling
57     trespass upon the owner's properties nor from charging a fee to trespass for purposes of hunting

58     or fishing.
59          (3) The Wildlife Board may allow a season on protected wildlife to commence on any
60     day of the week except Sunday.
61          (4) (a) The Wildlife Board shall establish fees for licenses, permits, tags, and
62     certificates of registration in accordance with Section 63J-1-504.
63          (b) The Wildlife Board may adjust the amount for an electronic duck stamp fee as
64     provided in Section 23-19-50.
65          (5) The Wildlife Board may not issue a license, permit, tag, or certificate of registration
66     as a reward for an individual's assistance with a prosecution for violation of Section 76-6-111.
67          Section 2. Section 23-19-50 is enacted to read:
68          23-19-50. Electronic duck stamp -- Fee.
69          (1) As used in this section, "duck stamp" means the migratory bird hunting and
70     conservation stamp described in 16 U.S.C. Sec. 718a.
71          (2) The division may provide for the purchase of an electronic duck stamp by an
72     individual on the division's website, as authorized by 16 U.S.C. Sec. 718p.
73          (3) Except as described in Subsection (5), there is imposed a $30 electronic duck stamp
74     fee for an electronic duck stamp purchased on the division's website.
75          (4) The division shall deposit the electronic duck stamp fee collected under Subsection
76     (3) into the Wildlife Resources Account created in Section 23-14-13.
77          (5) (a) Notwithstanding the fee amount described in Subsection (3), the Wildlife Board
78     may increase or decrease the electronic duck stamp fee to an amount that is no less than the
79     amount the division is required to submit to the secretary of the interior under 16 U.S.C. 718r.
80          (b) An adjustment made by the Wildlife Board under Subsection (5)(a) takes effect
81     when confirmed in the legislative fee schedule adopted in the general session of the Legislature
82     immediately following the adjustment.
