22     General Description:
23          This bill enacts a provision relating to the identification of a minor victim of homicide.
24     Highlighted Provisions:
25          This bill:
26          ▸     prohibits a law enforcement agency and law enforcement officer from disclosing to
27     a representative of a media outlet information on the identity of a minor victim of a
28     criminal homicide without making a reasonable effort to obtain specified consent.

37     Be it enacted by the Legislature of the state of Utah:
38          Section 1. Section 53-22-101 is enacted to read:

CHAPTER 22. LAW ENFORCEMENT REQUIREMENTS

40          53-22-101. Prohibition on disclosure of identity of minor homicide victim.
41          (1) As used in this section:
42          (a) "Criminal homicide" means the same as that term is defined in Section 76-5-201.
43          (b) "Media outlet" means a bona fide newspaper, magazine, or broadcast media
44     enterprise, whether conducted on a for-profit or nonprofit basis, engaged in the business of
45     providing news and information to the general public.
46          (c) "Minor victim" means the victim of a criminal homicide if the victim is younger
47     than 18 years old.
48          (d) "Parent or legal guardian" does not include an individual who is a suspect or
49     defendant with respect to the criminal homicide.
50          (2) A law enforcement agency and law enforcement officer may not disclose to a
51     representative of a media outlet the name or other personally identifying information of a minor
52     victim until the law enforcement agency or law enforcement officer has made a reasonable
53     effort to obtain the consent of the minor victim's parent or legal guardian for the disclosure.
